To find DH comment baffling

My DH asked last night whether having an affair was illegal.

He said 'i mean i know you can't go to prison for it, but it is illegal if you're married. like you could get a criminal record'

I then said 'of course not. you think the police are involved in affairs?'

He is now telling me he wasn't "totally wrong as you are breaking the contract with the government and god"

He is actually struggling with his mental health recently and has asked a few baffling things. He is telling me I'm being OTT by thinking this is a baffling question. What do others think?

No wonder his struggles with MH. Seems to be detached from reality tbh.

I'd also be concerned that this mental health challenge is potentially leading him down a conspiracy path. He's not necessarily concerned right now, but he's asking the kind of questions that suggest he thinks that the government or "they" control everything, see everything, manipulate everything etc.

Having said that, this sort of thing is where i could see DH being stubborn and dogmatic too. Eg I would say, "well no, no one can call polie on someone having an affair, no one ever goes to jail and no, it's not a crime but it IS breaking a contract" and he'll go down weird rabbit hole about what is TECHNICALLY the truth. For the record, I'm 90% certain DH has ADHD. Plus, his family have form for not being able to assess situations, especially risky situations, terribly well as well as a tendency to buy into conspiract theories.
