Mortage with a CCJ

I have just found out I have a CCJ against me - it's 4 years old. For context I didn't know about this and had an abusive ex who must have done this. I only found out as I needed to check my Experian as I'm due to apply for a mortgage soon!

My mortgage broker advised he couldn't help me and now I'm panicking!

Aibu to think I can still get a mortgage??

Has anyone applied for a mortgage with a CCJ?? Any success stories to make me feel better 😢

Not going to lie, it will be hard which is why the broker has said he can’t help you anymore. . What do you know about the CCJ? How much is it for etc ?

Ah, yeah CCJs can be applied without your knowledge - I live abroad but made sure everything was closed before I left because of these little bastards!

Right, number 1, they exist I believe for 6 years - so you've got 2 years left on this one. You'd need specialist advice about trying to get it removed if it's really not down to you - and it may not be doable in which case then yeah, that's a problen for a mortgage.
2 - they can be applied years later, they exist for 6 years from that point - so I'd check your ex didn't do anything else in case another CCJ gets put on without you being aware.

Call your local Citizen's Advice and ask them to signpost you to debt management (depending where you live that can either be in-house or another charity) and start from there.

I have spoken to another mortgage broker, she's advised that I should call to find out the details. It's for £829 and I'm going to pay it, one I know who it is - so it's satisfied, wait a month then apply for the mortgage.

Out deposit is like £70k

How much is the CCJ for? And I assume the balance is still outstanding.

There are mortgage lenders who will lend to people with active CCJs as long as it's been a certain amount of time since it was registered and the amount is within threshold. (I work for one of these lenders). I would also seek advice from another mortgage broker, particularly one who specialises in adverse credit.

@sillybilly18737 okay that's not a bad amount, I've seen a lot worse.

My knowledge of other lenders are limited but there are plenty of specialist lenders out there such as Kensington, Precise, Paragon, The Mortgage Lender, Bluestone, Pepper, Together are some names off the top of my head. Have a look at their websites although most of them will want you to apply via a broker. A good broker that has experience in adverse credit cases should be familiar with these lenders. Best of luck!

Do you think they would lend to us if it wasn't satisfied? As I don't know if we can wait that long for the mortgage as we had our offer accepted on the property we liked.

Simply adverse - best broker ever, got me a mortgage when I thought nobody could
The mortgage lender is the company my mortgage is with and they lend with a CCJ

You just need a decent broker. I’ve got an chequered financial history and managed to get a mortgage but we had to use specialists. Pay it off and explain and you broker will do the rest.

I know the company I work for doesn't look at whether or not it's satisfied, they only look at the date it was registered. The fact it was registered more than 3 years ago puts you in good stead, if that's the only issue I wouldn't say you're un-mortgageable by any means. If the balance is not satisfied then some other lenders could decline you, or accept you but will include it for affordability. Usually this means they take around 3% of the balance and add that to your monthly commitments to ensure the mortgage is still affordable. So an extra £25 could be added to your monthly commitments when it's being underwritten. But definitely make sure you have a knowledgable broker, there's plenty of lenders out there if they know where to look 😊

Someone else mentioned Simply Adverse who's a broker firm, I've dealt with them a lot at work, they know their stuff if you hit a dead end with your current broker. Good luck and don't panic ☺️

@pelotonaddiction thank you for your recommendation- how much did they cost, if you don't mind me asking? Did you have a CCJ? If so was it satisfied?

@sillybilly18737 no CCJ but debt and defaults that they didn't even blink at
Fees were added to the mortgage so I can't remember exactly how much but they aren't cheap (£1700 ish rings a bell) but worth it

I had been messed about by 3 other brokers, simply got me a DIP in 24hrs and kept in constant contact. My fixed rate is up in 2026 and I'm going straight back to them

Yikes. We had the same issue and had to put up 40% deposit and a broker who charged 3k. We were great full at the time and we still have the same house now. Hard pill to swallow though.

An ex did this to me (phone contract in my name £400) our mortgage is 11.6% could only get a bad credit mortgage paid down 30% deposit and my partners credit rating was perfect. Original rate started at 6% it's gone to the 11.6% over the last 3 years. The ccj is now off my report so one more year and we are hoping to remortgage (partner has a new job earning 50% more than previously so rebuilding our savings) the costs have nearly broken us

If you pay it, it will be marked satisfied; however, you'll be admitting the debt and your ex (if he is the judgment creditor) might pursue you for interest at 8% (the judgment rate) for the period between the judgment date and payment. If it was vindictive and granted by the court under false pretences. You might be able to have it set aside. Cor example, if your ex lied to the Court about service, and did not serve the papers, the Court should set it aside. If it's set aside, it's like it never existed and it should be deleted from the record, or you can at least show to lenders another order proving that the debt was deleted.

We went through an independent mortgage broker, I declared my 5.5 year old satisfied CCJ with him, sent him all 3 months bank statements, 3 months payslips and got a DIP with Halifax, I was over the moon but just found out Halifax only a soft search for DIP! I’m sure this would have shown my CCJ though?
We have sold our house and had an offer accepted on a house we love. The full application will likely be going through tomorrow, but I am
riddled with nerves!!! :-(

Forgot to add we have a 20% deposit. The mortgage broker seems positive, but I can’t help but worry!
