To expect neighbours to replace my rotten fence?

My neighbour's drain leaks under my fence and rots the posts. I only replaced them 2 years ago and they've rotted again. I've explained their drain is leaking but they've done nothing about it. I feel I'm having the p* taken out of me if I replace the posts again. AIBU?

What sort of drain? A manhole, downpipe?

ForgettingMeNot · 06/04/2024 18:01

Concrete post won't rot

brocollilover · 06/04/2024 18:06

how do you know their drain leaks under your fence?

brocollilover · 06/04/2024 18:08

and surely asking for repair of the drain is the priority?

TheSnowyOwl · 06/04/2024 18:09

Ask for their insurance details so you can put in a claim and install a concrete post.

fieldsofbutterflies · 06/04/2024 18:14

Do you have proof the leak is coming from their land?

I would replace the fence and use concrete next time.

BettyShagter · 06/04/2024 18:16

Why didn't you replace with concrete?

NCForQuestions · 06/04/2024 18:19

Replace it with concrete posts not wood posts. We've had the whole garden redone with them.

CJ0374 · 06/04/2024 18:21

Do you mean the water is underneath the fence and being sucked upwards-causing the rot? how do you know?

It's 8 posts and the water is from their rainwater pipe that isn't actually connected to anything. Water runs the entire length of my fence and onto my lawn which is absolutely sodden at the moment.

Edited

Because it's coming from their downpipe that's not connected to anything. My garden is sodden all along the fence line.

Does your household insurance cover include legal advice?

Does your household insurance cover include legal advice?

Yes it does but the problem started whilst I was with the old insurance company so I'm not sure the new one will help me.

are you able to take a photo op?

olympicsrock · 07/04/2024 16:38

The fuckers need to fix their drain!

olympicsrock · 07/04/2024 16:38

Solicitors letter

justasking111 · 07/04/2024 16:39

Your water board might be interested.

Mammma91 · 07/04/2024 16:41

I wouldn’t replace them again at your expense if it’s your neighbours fault. We just paid over £140 for 6 4ft posts. It all adds up!

You would think so wouldn't you but they're not, they said it's only rainwater and didn't want to get involved. It even runs across the public footpath when it rains heavy or snows!

If it's just rainwater, then that's what a soakaway is for. If it's not connected to anything then it will be causing damp problems to their house. I'd agree with PPs and install concrete fence posts and a waterproof membrane so that the water stays on their land.

Can you get a fence like this?

To expect neighbours to replace my rotten fence?
Firawla · 07/04/2024 19:31

You will have to sort it out yourself, wooden posts do rot with rain and general weather as well so you can’t really push it all on them -just sort it properly with concrete

Especially when there's gallons of rainwater being diverted from someone's roof onto them..
