My dog attacked another dog in our garden

My dog has never had any issues before regarding dogs or anything really. She is 4 years old.
where we live our front gated garden leads out on to a shared community garden / play ground, daughter often plays out in the communal area ( nearly 11 )
whilst son in the front garden.
its like a private estate - never any behaviour issues and no crime.
as you walk out of the gate of the estate, around a 5 minute walk away their is a little own run local restaurant.
they have a dog that walks around outside the restaurant alone which is next to a busy road. he often walks as far as ours does a poo and walks back- which has caused many complaints with neighbours etc
today DD was in the communal garden area and DS was in front garden with my aunt and our dog.
I was in the kitchen when all of a sudden I heard a commotion I ran outside to find my dog and this dog in a fight and I pulled them apart but the other dogs ear was bleeding by the time I managed to split them up.
my daughter was at this point also in the garden and crying.
my aunt had explained that daughter was running towards our front garden because she was being chased by the dog, crying saying it was trying to get her.
my aunt went to run towards her and daughter managed to swing the gate open and get in to our front garden as she did the dog followed and grabbed her trouser leg which then my dog pounced on the other dog which was when I had entered the garden and they were both fighting
I had never seen my dog like it towards another dog- when I managed to get the other dog off I noticed it’s ear was bleeding and my neighbour had ran to the get the owner who then came full blazing.
my dog was unharmed - I have checked her over a few times now.

I don’t let her off the lead when we are outside but it is a gated front garden and so I do allow her free roam.
He has now taken the dog and is phoning to report the incident of my dog causing injury.
my daughter is in pieces because she thinks our dog will be removed.

Call the police asap and report the dog for attacking your daughter . Your dog did nothing wrong imo . What breed is your dog , not that it matters to em at all but not everyone can be unbiased

I meant the dog that attacked the child not their unruly dog. Perhaps you should reread.

There’s no way a big dog should be loose and off lead and free to chase and bite children!! Well done for reporting. It could have been a lot worse.

Write out statements from both your aunt and your child as well as yourself, signed and dated. Contemporaneous statements/notes are evidence. Report the other dog as having attacked your child. Do NOT admit liability or damage to the other dog. Make it clear that the dog was attacking on your property and that any and all efforts to remove it from your property and protect your child were just that - protective. Do not get into any sort of discussion or argument with the owner, they are in the wrong. If they continue to harass you, report them too.

A Golden Retriever will not do that unless it is severely provoked.

It was protecting its family so, severely provoked. Their dog is clearly not trained and probably not able to rely on regular feeding, which is why it went for someone taking away food.

Poor bloody thing needs removing from them and rehoming.

Agree with others your dog did not attack the other dog, you dog was protecting your child. Make sure you report, their dog was off the lead in a public place, yours was on your property, albeit communal.

So a large dog is allowed to roam free,shit everywhere and chase kids one of whom narrowly missed a penetrating bite to the leg and the owner doesn't see an issue?

This dog is classed as a dangerous dog under the current dangerous dogs act.

Certainly not well-trained but nothing to do with feeding. Food tests most dogs.

update - no one has come yet regarding my reporting.
at 11 am this morning there was a knock at the door by the restaurant owner ( not with his dog ) telling me he didn’t report my dog and he won’t as long as I cover his vet bills !

Yes so I did highlight that the dog was chasing my DC but the owner states she is not injured and it was likely he was just trying to play with the kids
my DDs friends say they were all playing about and the dog had come towards them,
my DD had a pack of biscuits and had dropped them on the floor the dog went towards them and my DD bent down to grab them and the dog got defensive of them she still managed to grab them and then went to walk away and he chased.

Does matter that the owner says the dog was probably trying to play….the owner wasn’t there and can’t say jack shit. The only witness who counts is your Dd, if she feels the dog was attacking her then that’s enough. A dog doesn’t have to bite someone to be guilty under the dangerous dogs act, it just has to act in a manner which scares someone. If your Dd was scared then an offence has been committed by that dog/its owner.

a) He should have insurance
b) Any difference he is liable for as his was off-lead
c) He should be grateful you aren't suing him for shock

Do not pay any vet bills! His dog started it, his lazy dog ownership caused this. They should have pet insurance anywa6 and if they don’t that’s not your problem.

dont cover his vet bills.cite section 10 of the dangerous dog act to him (fear of harm is all that is needed, not actual harm).

And the fact that his dog trespassed on YOUR property when your dog defended your child.

oh and also the fact that had he been in control of his dog, none of this would have happened in the first place. What a tool he is.

I didn’t agree to it, I told him I had reported the incident and someone was coming out to discuss it.
I said we will let them decide who was at fault.
he then told my daughter just shouldn’t have run.
the thing is I don’t get this my daughter isn’t afraid of dogs- she lives with 2 sparkly and out second dog who tbh despite probably being a “ scarier “ breed didn’t even more from the kitchen in the commotion 😂😂😂

she is not scared of dogs, she isn’t nervous around them.

So the dog is free to wander, including in the restaurant? I'd be very unamused about a dog shitting everywhere are then potentially running round a restaurant too. What hygiene rating do they have?

I agree with PPs - if/when someone comes out, be clear their dog attacked your daughter.

The fact is, their dog should not be roaming without a human anyway. They are 100% in the wrong.

However, I would say that you should be reporting this dog every single time it is roaming without a human. Including in the future if no action is taking about the dog. Dogs do not attack in isolation (unless there are particular circumstances - and a pack of biscuits is not enough to trigger a dog attacking someone IME). It is just sheer dumb luck it hasn't attacked someone before.

But then, I am not surprised by the breed either. GSD owners (including mixes) fall into two categories: expert/responsible dog owners, and cunts.

How lovely - a nice attempt at extortion there.

As for only playing - it's possible. I have a pair of collies who like to play with each other by jumping on each other and then rolling around. I let them do that - with each other. I don't let them do it to people, because that would make me an arsehole. You can't let your dog play unsupervised with random children in the neighbourhood. That's total madness.
