To return car and ask for a full refund?

I bought a used car from a dealer 3 weeks ago. I got an independent mechanic to inspect it and all seemed ok. However, a week ago the engine management light came on so I contacted the dealer and they told me to have the fault diagnosed by a local garage (dealer is 100 miles away) and then claim on the warranty. When I took it to the garage they found 3 electrical faults and a mechanical problem which they say must have been there when I bought the car, given the short time I’ve owned it and have driven less than 200 miles since. They advised me to return the car for a refund because I am still in the 30 day period covered by the Consumer Protection Act.

This seems quite drastic action but I think I am within my rights to ask for a refund, especially as I’m not even sure if the warranty will cover the repairs (it doesn’t cover everything) and even if it does, all the local garages are so busy that they cannot book me in until mid April at the earliest. In the meantime I’ve been advised not to drive the car in case it makes the problems worse.

I have emailed the dealer saying that I would like to return the car but not heard back yet. AIBU to request a refund? Any advice?

Yes, but you want to tell them you are rejecting a car and want a refund. Not ask for a refund. Stand your ground if they give you any shit.

Don’t take another vehicle from them either. Money back & the money you spent on the local troubleshooting.

I can’t work out why you think you would be unreasonable to ask for a refund? Be assertive and exercise your legal rights!

weywardwoman · 07/03/2024 12:38

I’ve done this successfully

Had similar, threatened court, they paid up. Don't let them fob you off.

@WinterMorn - yep, you’re right!

thanks all, I just needed a bit of reassurance that I’m doing the right thing.

Don’t accept a repair or they will try and say you aren’t entitled to a refund under the rejecting a car legislation. Been there!

Just return and run!

Keep us posted 🙂

I got a full refund on a new RR Evoque a couple of years ago as the electrics kept failing. They actually offered me one after 6 months. Definitely stand your ground as you’re entitled to one.

If a car has that many issues it's a dud. We will naturally try and minimise that to avoid confrontation but you've been sold a lemon.

Be unambiguous in that you are returning the car as it's not as described or fit for purpose. Be prepared to be bullied and mansplained to so I recommend doing it by email wherever possible.

Call Trading Standards and they can talk you through the legislation and send you a template letter
