Universal credit shitshow

user63737383882 · 20/02/2024 13:26

My son moved in with his dad, three days before the end of the qualifying period for my universal credit. They have now taken £800 (he gets DLA and child element) off my claim for that one week he's been with him saying the whole month is then recalculated and given to his dad.

I work (he quit his job when son moved in even though son is an independent teen despite his disability) so I am also paying 100's in child maintenance for one child while he pays £30 a month for our other two that live with me (and isn't even paying that) plus owes me £1000's from when he was working when I had all three for the last 3 years.

I am a working single mum, struggling, son moving out has made me loose £800 a month in help I was getting and I barely qualify for any universal credit now, have another disabled child and another young one I pay childcare costs for and I can barely keep my head above water.

This universal credit overpayment is now going to be deducted at another £100 pm and I don't know how I'm going to afford to pay my bills this month and so stressed out.

I have empathy for you. Unfortunately there isn't anything you can do about it.

UC did the same thing for me when I moved. I stupidly told them I moved house 2 days before the assessment period ended. I was paying my rent, they were paying me in arrears. I was paying from my overdraft then the housing element came through 3 weeks later and would pay off my overdraft. Because I told them I had moved 2 days before my assessment period ended they concluded that even though I had rent to pay that entire month I lived there, that I didn't need my rent paying the whole asaeasment period even though they paid me in arrears. So then I was £850 in debt with no way of paying it off. Ive only just managed to pay it off bit by bit and it's been a year 😩
Tbh it's a shit system that encourages people to be dishonest because I will never make the mistake of telling them anything before a new assessment period begins ever again.

Nothing you can do about it. It goes on the circumstances on the last day of your assessment period. Does his dad claim UC - can he refund you some for the period he was living with you|?

Can you claim for the other disabled child?

Turtletoe · 20/02/2024 15:11

Is your statement correct firstly?
You should be getting disabled child element for the other disabled child, carer, 2 kids, yourself, housing, 85 percent of your child care back, your child benefit and then the dla on top aswell as your wages.

Yes the statement is correct, my rent is £300 over the LHA which is crippling me plus the child maintenance on top. I've had to cancel the kids clubs and any subscriptions we had, started shopping at Aldi and halved my food bill with strict meal plans.

I just don't understand I paid for my son for 3 of the 4 weeks plus another two weeks the month after while his dad was on holiday I don't understand how they come up with that.

And no chance of dad paying back anything

Unfortunately that is uc. If your assessment period was the 1st to the 31st, and your child moved out on on the 28th then that is correct. Had your child moved in with you on the 28th though, you would have received the child part, disabled part, and caring part for the whole of the month. Swings and roundabouts with uc.

What lha do you get? If its 2 bed, you can ask for that to be upped for 3bed when you have a disabled child on the claim.

Ask for it to go to a decision maker.

You can also apply for a dhp for the loss in rent. Apply though your council.

Im not understanding how you lost 800 on uc though Which is why u asked if your statementis correct.
your child part should still be 2 kids, your youngest takes the place of the eldest as you should get money for 2 only. (You referred to the youngest as very young so assume you didnt get for 3 prior to eldest moving out)
Your caring responsibility should be moved to the other disabled child, as you can only get that for 1 child on a single claim.
All you should have lost is the disability payment from uc, which at the most be 456 pound.
