AIBU to think I should not be demoted during TUPE

This is maybe not a AIBU reasonable but I do want opinions. I am not drip feeding but need to be really careful that this isn't too outing, so please bear with me.

I've been working for my (relatively small) employer for 10 years & worked my way up a quite senior position - think 'Head of'. We are now being TUPE'd into a public authority and are just entering the consultation stage.

My new role shows that I've been put into a team that they feel is closest to what I do now & they have taken all my staff away (it was only a few but that's not the point). I'm arguing that the team is not the right fit for my role so I'm working through that with them. My fear is that if it goes ahead as they've planned I'm going to be in a fairly junior role compared to what I do now with less responsibility & no staff. I know that part of my role will be done centrally, policies etc & I understand that is inevitable but I feel that this will be detrimental to me from a career perspective.

They propose to runs job evaluations 'soon', when they evaluate mine I fear that the effective demotion will effect not only my salary but will set my career back considerably as the role won't be as varied as I do now, not will it have the same job title. I'll be essentially pigeon holed into a role I developed out of 5 years ago.

Can they do this? Do I have any rights other than contractual during this process? Sorry if I've not given enough info but I'm a bit emotional about it at the minute.

Contact ACAS and get some proper advice. I tuped many years ago and it had to be ther same terms and conditions as reasonably possible. For example, we no longer had a work place nursery so they signed us up to child care vouchers as the next best alternative!

It won't change immediately but it's only protected for 2 years. It's more the impact the demotion will have on any future prospects that I'm worried about to go from a Head of Service to an 'officer' is a big demotion

Tupe means you retain salary, terms and conditions, although role may change. If it turns out otherwise you are entitled to be considered for a redundancy process(and your years service carry over).

Get advice from your union. They should be all over this tupe anyway.

We don't have a union unfortunately. I was thinking of joining one just to get their support on this as the company we're moving to has Unite.

We're moving on to their T&Cs which are much better - I don't have any issues with that.

It's just the fact they are essentially moving me into a more junior position which I don't want - I'll be doing essentially the same role but with no staffing responsibilities. I understand there will need to be some compromise but to move from a 'Head of Service' to an 'officer' is too much of a drop & will impact any future job applications

You need to ask them how they have mapped the grade structure between the two organisations and ask them to explain it fully
