but would you be held to your notice period if you’ve not even started?

I think in theory you can be, but doubt it happens often!

You could. It would depend on the employer, so no-one here will know for certain. Seems unlikely though, what benefit do they get...

They won't come for you for damages, and your notice period during probation is probably like a week, and they won't want to invest in training you knowing you'll only be there a week. But what a waste of their time to do this...

We had one guy who started on a Monday and on Tuesday he decided he no longer wanted to relocate to the UK and went back to France.

In theory the could sue you but they won't. Costly and too much hassle.

Wouldn’t be my intention to mess anyone around or waste time or basically blacklist myself but have had a counter off which is more money and faster progression

I would have expected the contract to have had a probationary period, usually 3 months. In this time either party can terminate with zero notice.

Either way I wouldn't worry, good luck with the other new job!

Is it from your current employer?

They didn’t care before now and these things are often not as promised.

I’d never give up a job offer for a counter offer.
