EHCP 1 on 1 wording and help.

My child has autism and is in year 1 at a mainstream school. This wording below in his EHCP does it mean he should be being watched all day?

From EHCP word for word: Child will be provided with additional adult support, equivalent to 10 minutes in each hour of direct 1 to 1 intervention. For the rest of the hour he will receive adult oversight and be facilitated to access the continuous provision ensuring he has time to explore

I am beginning to think school is not watching him all day, not even close. As he fell over at school and needed a plaster and did not get help as no adult in the class noticed. Due to his language delay/ social difficulties he can't ask for help. He has slightly better language at home and asked me for a plaster. I asked a multiple choice question and he said it happened at school (he can't answer an open ended why question). AIBU to complain to school? To who - teacher, senco? Thank you for any help.

I might be wrong but, from the wording, I would assume that school staff are doing 1-1 interventions with him for 10 minutes in every hour and then watching him at the same level as all the other children in the class for the remaining 50 minutes. His play would be supported and encouraged alongside his peers but not with an adult focused only on him.
I think first aid may be a different issue. Did you have a bump note? I’d certainly ask the school what their policy on little accidents, plasters etc would be. It’s impossible to see every bump and graze happen (assuming class of 30) but little children are usually brilliant at drawing adults attention to their friends falling over or having accidents - even if the child involved isn’t hurt. At my place of work, we try not to use plasters unless absolutely necessary when doing first aid although I’m aware some children don’t feel ‘seen’ unless they have one. Generally we only write bump notes for hard landings (possible bruising later), head injuries and if there is blood. Otherwise it’s TLC, a wet paper towel and lots of sympathy.
Do talk to the school in a calm way, I’m sure they’d be happy to explain both the EHCP and their first aid approach. If it’s the class teacher then there’s usually more time for a chat after school than before so you shouldn’t be rushed.

I would interpret the EHCP same as previous poster exactly.

Is this the case when you have a child that can't ask for help due to a language delay?

I think in this case it is worth approaching the school sendco and opening a low key dialogue about your son. It doesn't matter what is on the ehcp what matters is that your son feels he can draw adult attention when he needs it.
In some ways I think ehcps can cause a problem because I have known a situation to develop where everyone is focused on the ehcp not the actual child.
But that's just my experience obviously.

Yes the school only has to provide one hour from the school day of 1 to 1 direct support wth that wording regardless of your child's difficulties. Contact SOSSEN or IPSEA for advice on what you need to do to alter that.

Lea love to do crap like this. These are legal documents and they make them as fluffy as possible so they can't be tied down. Get advice. You want it very clear and very specific.
If its same as the old statements I'd want wording like
'One to one adult assistance for 30 hours per week'

Hankunamatata · 12/01/2024 07:52

Out local lea loves to only pay for 10 hours per week so makes these documents wording unspecific so they don't have to pay.

Most children with EHCPs in a mainstream school don’t need this amount of support.

My DS EHCP states ‘25 hours of 1-1 support per week’. It took private reports and submitting tribunal paperwork (LA back down before tribunal) to get to that wording.

Zooeyzo · 12/01/2024 08:02

You want number of hours ie. 25 hours 1-1. Has to be specific. I'm having the same fight with LA and appealing section f.

In general schools should notice if a child needs medical attention, and should exercise particular care if the child has difficulties in alerting them, so you are justified in asking them at least to look into how this happened and what steps they will take to ensure it can't happen again. However, the wording in the EHCP doesn't guarantee 1-1 care all the time.

How long ago was the EHCP issued? If you want it to be amended, it may be sensible to ask for an early annual review where that can be discussed, and you can appeal if an amendment is refused. Did anyone get speech and language therapy advice before the EHCP was finalise, and is your son getting SALT provision?
