Who’s in the wrong? Neighbours and fences

Neighbour 1 tree falls through fence and breaks it. Neighbour 2 can’t get fence fixed until the tree is removed. Neighbour 1 gets tree removed after a few months but forgets to tell neighbour 2 and it’s the fence at the end of a big garden so not easily seen. Dog of neighbour 1 escapes through fence which is broken and goes missing.
does neighbour 1 have the moral right to be pissed off at neighbour 2?
Im on the other side of neighbour 2 and don’t see how it’s their fault but it’s sparked wars

Thank you everyone for your input I’m so worried about the little dog it’s still missing and it’s been 12 hours now

Neighbour 1 is upset about the dog and can be cut some slack- but the whole thing is their fault.

Hope the dog turns up soon. Hopefully chipped?

The person who damaged the fence is responsible for the repair and security of the site.

The dog owner is entirely responsible for securing their dog - until the fence was fixed it should have been leashed in the garden.

Doesn't matter how the fence went down or whose fence it is. The dog owner MUST control their dog.

Its your responsibility to ensure your animals are contained. I hope you find your little dog though, especially in this weather.

If neighbour one keeps giving grief then they'd better be prepared for neighbour 2 to look into claiming in insurance.

If Neighbour one was pissing me off I'd be willing to take a hit on my own insurance if needs be if I thought it would also push up the neighbours premiums.

There is no legal obligation generally to fence a property and therefore no legal obligation to replace it. Presumably neighbour one could have paid for repair after their tree was removed (although again not obliged to) but they are the one needing the containment of their pet which is their responsibility.

Neighbour 1 should've removed their tree from the fence in a timelier manner.
Neighbour 1 should be paying for the repairs to the fence.
Neighbour 1 should've ensured their dog their dog was kept away from the broken fence.

Neighbour 2 should politely tell them to f off.

Neighbour 1 should be getting the fence repaired or at the very least paying for it as it was their tree that broke it.
Its their own fault the dog is missing as they knew the fence was broken as it was their tree that broke it.

Neighbour 2 has done nothing wrong.

Neighbour 2 did nothing wrong at all. Neighbour 1 should have got the tree removed within 2 weeks. 2 months was too long. Also Neighbour 1 knew about the damaged fence, so should have put something temporary up like chicken wire and supervised the dog in the garden. Also he should have informed Neighbour 2 when the tree was removed, because it's winter, no-one is going into their gardens right now.

Neighbour one is the one who hasn’t made sure the dog is in a contained garden - presumably they knew the fence wasn’t fixed so they shouldn’t complain. But if they’d been trying to keep dog contained and neighbour two was constantly letting them down re fence I can see they might feel aggrieved. Neighbour one should have been talking with neighbour two about it. Especially since it was their tree that did the damage.

Neighbour 2 is under no obligation to replace the fence though

oh absolutely. I’m just trying to imagine any possible way that N1 might feel they have some sort of reasonable grievance, given it’s so patently their own fault. So only if N2 had been constantly saying “oh yes I’ll fix it on Tuesday I guarantee it” and going back on it, or something implausible like that. Doesn’t sound like any of that has happened - so it’s totally a N1 problem.
