Can I be evicted for having noisy children? They sleep all night but they wake up at 6 am but they go to bed at 7 pm. But during the day is impossible to keep them super quiet and the neighbours are complaining. We have only been two months in the property. The state agency said they will sent a letter and I don't know how this is affecting our tenancy. I have so much anxiety and I don't have family to support us in the country. Us there someone who can advice me if they where in the same situation?

I want to clarify that we are renting private and we don't get any government benefits, I do feel this people might have racist issues as they started complaining like 5 days after we moved. I just want to know my rights

Depends how much noise the children are making. Its not reasonable for you to allow them to be excessively loud at 6am. Your neighbours may get somethibg to measure the noise level they can hear

Ilovegoldies · 11/11/2023 14:42

How old are your children? Is there a reason you can't keep them quieter?
Mine were like this and they were old enough to understand the consequences if they were excessively noisy.
There is no noise nuisance caused by children so you are ok from a statutory nuisance standpoint.

I don't let them, they usually watch tv quietly but I have a 3 year old and sometimes he makes tamtrums, usually try to keep them completely quiet before 7 but as well they are complaining that they play in our garden

Well really it depends.
It depends on if it really is too noisy
Or if the neighbours just think it's too noisy but it's actually not legally too noisy.

Junmex · 11/11/2023 14:59

We don't allow them to play in the rooms adjacent of the walls we shared from the exemption of the living room where they watch tv, it seems to be a new complaint all the time and I feel this is something personal and I want to know how can I protect myself.

Well really the only way to find out if it really is too noisy (legally) is it neighbours log complaint with environmental health and have noise recording device put in I guess

If you're private renting and they complain enough to the landlord, the landlord might get sick of it and evict you, yes. But it's not a short process as far as im aware.

My neighbours had two boys, the noise and arguing was from hell. Glad they moved as my life was miserable. They spent most of their time in the garden so I could hear everything. Why do you think is racism?

Thought this was gonna be about Trish Grin

Landlord can evict for whatever reason just by serving you with section 21, it gives you 2 months notice. As long as you pay rent and don’t cause trouble after certain hours they can’t complain to council/landlord. They are kids for gods sake and they all make noises. Council will make you wait until court proceedings ended and you will have bailiffs date to evict you. Make homelessness app with council if this happens.
