Should shop refund me?

Purchased pair of trainers from a cool trainer shop in April. Tried them on in store and loved them.

Didn't wear immediately- they got put in wardrobe as were a more autumn winter shoe.

Just got them out to wear and shop has given me two right feet.

Ive not for a reciept but have proof of purchase from my debit card.

Should the shop refund or exchange for me? Unlikely those trainers are still in stock, they weren’t cheap (£98!)have called the shop numerous times today but no answer, emailed too.

kicking myself I didn’t check them when I got home!

Depends on the store but I’d think the store would be willing to help if they have good customer service. They might have 2 lefts in the store so it’s in their interest as well. Good luck OP.

I would show purchase on bank statement and absolutely fight for a refund. Consumers Act states that articles must be fit for purpose whatever the shop's exchange time frame

I would ask for a refund but go into the shop explain the situation as see if they offer any solutions

Ideal to they cold find the correct shoe r you could accept store credit for a replacement. But from legal view they are in breach of contact for failing to supply you with what you paid for i.e a pair of shoes and the limitation period for bringing a claim under contact is 6 years so you are entitled to a full refund.

You might get lucky.

I got a refund for some walking boots after several months and some wear - we had been sold two boots in different sizes! I think they were sizes 4 and 6, so really different. They asked why we hadn't noticed, but they were for a child who didn't object at the time...

The consumer rights act has a. Short terms right to reject in the first 30 days after which there is a right to repair or replacement and then a final right to reject or price reduction in the first 6 months after which this may be reduced to reflect the use you have had, which would be judge on the facts

Selfridges customer service is appalling. I placed a big order (had wedding vouchers to use!) and when it arrived there was an item missing. When I told them they acted like I was lying and I had to fight them tooth and nail to get them to actually send me the item I’d bloody paid for. Really put me off them.

I would buy another pair, take the shoe you want and then return the others for a refund.

It's not a question of luck.

The shop is being unfair. They should have a no refunds policy for goods they don't want tried on.

I would try. If they say "NO" I don't think they'd be wrong or you could argue with them given the time, but no harm trying.

It reminds me of when I bought a pair of trousers from C&A many years ago. I put the bag in the wardrobe and didn’t get them out until a year later. One leg was shorter than the other.p! I took them back, expect to be ridiculed, but they did refund me for them! They could hardly argue, really!
