TW - Sex Murderer - Jordan McSweeney - 5 years for £41

The verdict on McSweeney's appeal has been published. The three judges presiding are all female:

From the judgement:

"In the early hours of 26 June 2022 Jordan McSweeney, now 30 years old, subjected Zara Aleena to a brutal and sexually-motivated attack causing her multiple injuries from which she tragically died.
.....
We therefore allow the appeal. We quash the minimum term of 38 years on the count of murder and substitute in its place a minimum term of 33 years. We also correct the amount of the victim surcharge imposed, by increasing it from £187 to £228. All other elements of the sentence remain unchanged."

Am I unreasonable to believe that women should only lend their vote at the next election to a party that makes a binding pledge promise commitment to ensuring that the value of a woman's life cannot be mitigated by her murderer rendering her unconscious, killing her quickly or having had a tough life.

YABU - criminals should retain inalienable human rights that must be respected irrespective of their past behaviour or the nature of their crime

YANBU - criminals inflicting life-changing damage on their victims should not be released until the victim is returned to the degree of health they enjoyed before the attack

This might be better off in feminism, but I would say that YANBU. Killing someone brutally is on the same lines as doing something that will render someone permanently traumatized, in which they will be able to enjoy almost nothing in life.

I’m massively over simplifying it but part of it was that the original judge found that him taking her mobile phone from her was in order to prevent her from calling for help and that he had caused Zara to suffer fear before her murder (there’s a legal term for it, but it’s gone out of my head). So the original judge gave him extra time for that, before knocking off the five years credit that he got for pleading guilty.

The grounds of appeal were that the phone was just one of several items that he’d taken from her, so it was wrong to say he’d taken it for that reason, and in order to give extra time for causing her fear, it had to be that the level of fear went above and beyond the fear that any victim would experience while they were being raped and murdered and that, because she’d been unconscious for some time, it couldn’t be said that she had suffered as much as she would’ve if she’d been conscious during the attack. They agreed that 30+ years was reasonable but 38 years was too much. And the Court agreed.

Fucking horrifying.

Should have been hung.

If you attack and murder someone else for no reason like he did, you don't deserve to live.
How a human being can do that to another human being who is just going about their life just does not deserve to live.
We also don't want tax payers money spent on keeping someone alive in prison either.

This was a truly horrific crime, and I doubt I’m the only person to have thought at the time that if we had the death penalty (I’m glad we don’t) this case would merit it.

However, having read the transcript, I think the appeal was justified and the decision was a good one.

Sentencing guidelines exist for good reasons, and in answer to the OP, yes even convicted murderers have human rights and deserve to have the law applied correctly.

Having said all that, I certainly hope he will never be released and it’s pretty hard to imagine he is capable of change such as to allow the Parole Board to recommend it.

That sort of makes sense then I suppose, they have to try to apply the evidence ot the decision making

However, if he remains in good health, he could easily be released on licence at 63 and live another 20 years or so.

if he dosent deserve hanging or a full life sentence then what does he deserve?
He'd been committing crime all his life, beating up girlfriends and then murdered Zara in an unprovoked attack.

How much worse does it get?

Country is just getting softer and softer on sentencing.
Parole Board are another bunch of do gooders who let people out when they shouldn't be let out.
Why take the risk?
Why should he have freedom again ever?
Will these stupid people who decide the sentencing ever think of the family of the murdered person.

Not only have they got to live with the loss, someone won't then lock the killer aware for ever and reduces the sentence.
What would they say if it was their daughter!
Don't know how they sleep at night?

I cannot believe how this has happened. So all you have to do to get a lower sentence is to beat a woman so hard she loses consciousness before you sexually assault her?!

Nope, raping someone is not a "sexual encounter". It's a rape.
Yes, children from traumatic and deprived backgrounds are let down systematically by this country. But inwould hazard a guess that with 28 convictions for 69 offences between 2006 and 2022, this particular individual would have encountered organisations and opportunities that gave him the chance to turn it around, had he so wished.

Who defined those criteria, took their proposition to the electorate and explained that there would be boundaries where acute injustice might be perceived and experienced?
This is another example of MPs, civil servants, lawyers and judges who are often geographically and economically insulated from the likes of murderers like McSweeney, Damien Bendall and those responsible for the femicides that become a routine element of the news cycle https://www.theguardian.com/society/2021/oct/02/the-81-women-killed-in-28-weeks.
Miscarriages of justice continue and while there is no doubt that capital punishment has been used for partial and political ends, with DNA, CCTV, GPS and other new forms of evidence, I believe the bar should be considerably lower for deciding that someone is a danger to society and they should never be allowed out.
Consideration should be given to the knowledge and experience that a predator has gained - both from their crime(s) and previous exposure and experience of the police and criminal justice system - which both of the individuals that I mentioned used to their murderous ends.

I would usually be accused of being a bleeding hearts lefty, with childhood issues etc. But in no way shape or form does a bad childhood give an excuse for this. This is a vile excuse for a human, he set out to hurt women because he was turned down.

She didn't turn him down, it was a random attack, he didn't even speak to her.
