Abusive ex husband and Financial Settlement

I have put an application for financial settlement against my abusive ex, the deadline for exchanging documents was 2 days ago. I emailed mine to him and the court he hasn’t emailed his, instead on the day of deadline he emailed saying he has health problems and will be going to have surgery and require extensive after care so can’t make the deadline to exchange documents and is asking for rescheduling. He hasn’t send any proof with his email. I didn’t respond nor the court respond.

my question is now he’s miss deadline to submit documents can I email court asking for him to send them ( just ignore his email)? Anyone experienced this situation and how did you deal with this? I don’t have a solicitor and can’t afford one. Thanks

I'd wait for the hearings. You've done your bit. Let the court deal with him. Ignore his email. It's likely stalling tactics. I've also self repped with an uncooperative ex and it was draining. However, I just kept on doing what was asked of me. Ten hearings later we got there 🙄

No particular experience or knowledge but I would have thought the court would expect some sort or supporting evidence for failure to meet the deadline such as a doctor’s letter. Of course whether they let him have any leeway could also depend on the nature of the condition and how imminent the surgery is which a doctor would also be able to clarify. Is he unable to read? Write etc? On the other hand, if he is going to have a general anaesthetic very soon, he would normally be advised not to make major decisions or sign important documents for a certain length of time following the surgery.

Well yes, but he should be signing it now/yesterday - before he has that excuse, shouldn't he?

I believe he’s just making excuses as he’s fit and healthy last time I know but either way where’s the evidence
He doesn’t want to do this so he will drag it as long as he can I think 😢

Hi either you wait for the next hearing for the Court to make an order or its up to him to make an application to the Court for extra time, which he would need to support with evidence

I would ask the court how they plan to proceed, and perhaps highlight that he is possibly trying to exert control over the situation and you. Typical behaviour for an abuser tbh, the court will be well versed what to do in these circumstances.
