Gingerbread joins legal action on CMSPOSTED 15 AUGUST 2023

We’re pleased to announce that Gingerbread has received permission from the courts to “intervene” in a legal case to challenge the persistent failure of the Child Maintenance Service (CMS) to take “proper or effective steps” to recover maintenance payments from absent parents.
The claimants in the case argue that problems with the CMS are causing them “significant and prolonged financial difficulties” and “pushing them into poverty”.
As “third party-interveners”, we hope to provide the court with our view on how the CMS is working for single parents. At Gingerbread we hear day in, day out from people who are being seriously let down by the system. They tell us that they are owed thousands of pounds from their child’s other parent and that all too often the CMS is failing to put enforcement action in place to recover it.
Wider evidence shows that:

  • 140,000 children are not receiving a penny of the maintenance they are legally entitled to[1];
  • since 2012, when the CMS began, £547.9 million in unpaid maintenance has accumulated[2];
  • if child maintenance were paid in full to all children in separated families living in poverty who currently do not receive financial support from their other parent, it would have the potential to lift 60% of them out of poverty[3].
We have already provided evidence to the court at various stages to highlight that the experiences of the claimants are typical of how the system operates and are not isolated incidents. We were pleased to report in March that the case was given permission to proceed to a full hearing. The case will be heard at the High Court 3rd-5th October. Other action on the CMSOur work on this legal case is part of our broader campaign to make the CMS fit for purpose. Along with other charities, we recently supported two new Bills on the CMS to become law. The two new bits of law seek to make things better for survivors of domestic abuse using the CMS and to strengthen the enforcement powers of the Child Maintenance Service (CMS) against non-paying parents. However, with total arrears sitting at £547.9 million, we are concerned that the changes won’t go far enough. That’s why we’re involved in this legal case. Radio silence. I have been patiently waiting on the outcome of this Judicial review as it reflects all of my struggles as a resident parent, a female, a mother. The reality is, we are constantly discriminated against, and so are our children. What is the outcome of this review? It’s hugely concerning that there has been nothing, no update in the press.

Hello, I haven’t voted either way but wanted to say that the hearing was in early October so it’s very unlikely that the judge has issued a decision yet (they don’t tend to do so on the day, and instead reserve their decision). I guess it might be 1-3 months before the decision is published.

I think you aren’t getting support because a) you are jumping the gun as decisions take some time to be published,
b) you’ve decided to apportion blame on other women and
c) your posting style is aggressive.

I agree with the principle from the Op here though. I have friends where the Dad pays fuck all, and for some reason that’s just accepted? If the mum paid fuck all where would these children be? It’s ludicrous.

I appreciate that decisions take time to be published. I have lived my life through CMS and subsequently the tribunal service, I am well aware of the disgraceful, incompetent service, that should be scrapped. My posting style might seem aggressive to you. I would ask you to try and understand being a resident parent, working a professional job, having your ex being a Ltd Company Director and bringing up two children on £100 support for an entire month. Could you do it? Is this acceptable? They were found to be lying within the tribunal, like many others. Women and children need better protection.

CMS is a disgraceful misogynistic tool, that has been constructed by male idiots in Parliament. It has never put the child at the centre, which is their legal right. For the child/children to be properly financially supported by both parents.

I remember the “super dad” movement (men dressing up as superhero’s to highlight how unfair decisions on child custody) received so much press. However something like this that can change the lives of lone parents - usually predominantly women - is silenced.

I am guessing its this OP

I agree its about time men start paying for their children and at a decent amount. The self employed loopholes need to be closed for starters.

However if my DP doesnt pay his CM how is that my fault? What arrangement he came to with his Ex is none of my business, anymore than her knowing how much I earn.

YANBU @Theemeperorsnewclothes. CMS is not serving children. I worked in the original CSA back in the 1990s and I have seen as significant shift in society. Back then, men could leave their children without support. That has changed. Now men are expected to provide financial support.

Unfortunately many go out of their way to not provide adequate, fair or honest support. I'd like to see CMS chase these men and prosecute the dicks withholding financial support. However they do it.
