To not pay?

So I'm a bit confused and was hoping someone could help.
My son is moving to a different nursery on the 30th of October. I've paid up to the 20th of October for his current nursery. I've been told I need to pay for the next month too. I don't really fancy paying for two lots of nursery fees, especially as he would only attend for a few days! I would rather not pay and just not send him in after the 20th until he starts the new one. Is there something I'm missing as to why I HAVE to pay?

Did you give written notice? Verbal may not count.

A months notice usually means you would tell them the month in advance, and pay for the full following month.
So, if you gave notice in September then you pay for all of October. You shouldn’t be paying for November though.

Not really

A months notice is "I'm leaving in a month" 31 days max

A calendar months notice, could be read to be different, possibly

CraftyPance · 03/10/2023 22:55

When did you give notice?

Intelligenthair · 03/10/2023 23:49

What date did you give them notice in writing, and what does your contract say?

Those are the only things that matter here tbh.

Naddd · 04/10/2023 07:06

Did you read the post?

Op if you've given a months notice then you'd have to pay that month and that's all

When did you give notice? It all depends on that as to what if anything, is left to pay

Yahyahs22 · 04/10/2023 07:26

I gave official notice on the 18th of September.

So even if its a calendar month for notice then you should pay to 31st October. Are they asking you to pay for November too?

Yeah they're asking me to pay for another month, from the 20th even though I obviously won't be sending him in.

So they are asking you to pay from 20th October to 20th November even though you gave your 1 month notice on 21st September? They must have made an error. I would email them for clarification

His nursery asked for a month notice which I gave, more than actually. I'll check out the contract. Didn't even think of that! Thank you

Why wouldn't you think of the most obvious thing in the first place? 🙄

I know, isn't it so strange that a human made a mistake and wasn't utterly perfect like you?

So assuming:

  1. your contact matches what they told you - 1 months notice
  2. you gave notice as per the contract (usually has to be written notice) on 18th September

Then regardless of whether the notice is 1 month from 20th of the month or 1 calendar month you've done what you need to. And then if this is the case I'd be very clear that I was not paying for November.

But it all depends on you having given notice according to the terms of your contact

Yeah that's right, and it was written notice, an email as that's what they asked. Seems odd, right? I'll guess I'll only know for sure when I can check the contract which I won't be able to do till Friday

Livelovebehappy · 04/10/2023 09:15

Definitely question it. I wouldn’t wait until Friday to see the contract. I’d be asking to speak with the nursery manager for clarification before then. She or he should be able to explain the reasoning behind why you need to pay for November. If they do say it’s def in the contract, then you know that’s where the reason lies, and you can read it through to check.

Bearbookagainandagain · 04/10/2023 09:15

Actually I had a similar confusion with my nursery about start date, because they only work with calendar months but didn't make it clear to me at all. So when we discussed start date for my second, I told them mid-October, but on the system they only booked from November. I didn't care much so thought nevermind, but actually they had booked ad-hoc sessions for October which I didn't see. I think their system doesn't let them book kids half way through the month, and same thing for the notice when I dropped a session, it was booked for the next calendar month rather than 30 days later.

It might be stated on the contract but I don't think we even have a copy of that anymore. They should have reminded you when you asked.
