Neighbour's patio and my extension

My living room is an extension into part of the garden. My next door neighbour (terraced house) doesn't have any rooms that touch it - his equivalent space is still garden.
He's just built a patio and it touches my wall. I mean I can hear that his flag stones or paving or whatever is connected as every time he goes out, sweeps, etc (he does things like this this a lot for some reason) it feels / sounds like someone banging on my wall.
I have two questions:

  • is this likely to cause any damage, damp anything like that? Is there any reason why his patio should not touch my actual wall?
  • Is he legally allowed to do this or should I ask to see what he has done?

So as not to drip feed, he is going to be very shirty if I ask to see it. I really do not want to hear that I have to do something about this because it will definitely be a battle. the fact that I can hear and feel stuff happening directly on my wall troubles me though and it makes me wonder if it is ok.

is it your extension that is directly next to his patio?
If he hasn’t come over the boundary I don’t think there is much you can do.

If you've both built up to the boundary I don't think you can do anything.

It's generally advised not to build right up to it so you don't have to rely on the other side for access.

It makes me wonder how well insulated your wall is? What are the relative levels between his patio and the floor of your extension? If it’s pretty level then you should have a DPM in your wall which should stop moisture tracking up above this line.

Do you know what your wall construction is?

Is he bashing against your wall with a brush when he's sweeping? Is that the noise you're hearing?

Legally, yes he is completely entitled to put a patio in his own garden.

You cannot dictate he can or cannot have hard standing on his own land. As long as he doesn’t come over the boundary it is not your business. If you chose to build right up to the boundary then you always run a risk. Hence why most people leave some space.

I do know some house extensions that purposely leave the boundary fence in (even though the extension wall is right next to it) to avoid what you are experiencing.

How long ago was your extension built?

It seems a bit shoddy to be able to hear someone using the patio through it.

The extension was built a while ago, before I bought the house almost 10 years ago. The patio was built this year. I think the extension was built right up to the boundary yes, because the fence between the gardens carries on where it leaves off. I have no idea about the construction etc but the people who sold me the house left some paperwork so I can have a look

As long as he hasnt breached your DPC I think he can build it anywhere he likes on his own land.

How do you know its touching your wall if you havent actually seen it?
