Cousin used my nans disability badge

hi just wondering can a traffic warden find out who a disability badge belongs to from the number of the front of the badge?
basically my cousin who’s an idiot decided to use my nans blue badge and he said the trafffic warden asked to see it and he refused to let them see it so they took pictures of his car front and back !!
my Nan is absolutely furious with him but we are thinking now what’s going to happen ?
will my Nan get in trouble even though she didn’t know ? He used it he takes her shopping and she left her badge in his car my Nan is a non driver so he does do a lot of driving but today he has used it for himself when he should not have done!!

It's not your Nan's problem. I doubt it is a criminal offence, but there may be a fine for your cousin to pay.

Hopefully they learn their lesson.

ill just wait and see what she gets in the post about it sure it will come soon enough
they will no who the badge belongs to anyway as they took pictures of it after taken pictures of the car but cousin obvs only get the pics of the blue badge from the front with it being in the car

Misuse of a disabled badge is a criminal offence. I think (?) it comes under the umbrella of fraud.

If it's a council who endeavours to prosecute all misuse of blue badges, they'll get a copy of the CCTV to show this isn't the case. It's a criminal offence, rather than civil, so local authorities take it seriously.

Your nan must not lie to anyone about it. If events transpired as you describe then she has done nothing wrong. Hold your cousin accountable for their own ludicrously immature behaviour.

Yeah my Nan hasn’t done anything wrong she just happened to leave her badge in his car as he does all her shopping with her takes her back and too
and that’s when he’s come to use it
he thinks he will have to go to court now and get a fine but I’m really not sure how this is gonna work .

I very much doubt anyone will go to prison, especially an elderly lady.

I would also doubt that if anything, your cousin will get more than a fine, if that. You don't state if your cousin said that your nan wasn't even with them - therefore what actual proof of misuse is there?

Is this ideal? Nope
Was the cousin an arse? Yes
Is anyone getting a prison sentence? Highly unlikely

Also - I believe the rules for BB use USED to be that you could use it if you were doing an errand for the badge holder - you cannot do this now - the badge holder must be present (I assume this part is a blanket rule)

You have misread my post and link.

Your cousin is likely to get the £1,000 fine. They will find him via the DVLA and his car reg.

Your Nan may, or may not, have her blue badge confiscated. I highly doubt she will be fined.

Even if Nan lies and says she was there the fine will fall under this part. He refused to show it.
If any of these people ask to see the badge, you must show it to them. If you do not, you will be breaking the law and you could be fined up to £1,000.

Surely if the grandmother did not permit the misuse of the badge, she has done nothing wrong? It’s not unreasonable for the badge to live in grandson’s car if he normally takes her shopping and no-one else does. What is unreasonable (illegal, actually) is him using it when she wasn’t present.

Or as someone said, that she had just been dropped off. Your nan doesn't need to worry. Your cousin is silly and should have showed it and said your nan had just been taken shopping and he was just leaving.

Because he didn’t show it that’s the bad the thing but he was obvs worried showing it cos he knew he shouldn’t have been using it !
so we shall see what happened weather Nan will have it removed of her but if that does happen I think that’s wrong cos she didn’t know and it’s not her fault but I kno they don’t look at it like that

I did not suggest that anyone has gone to prison over using their Nan's blue badge. People have gone to prison for perverting the course of justice by lying to get their relative off the hook. Perverting the course of justice is rightly seen as a far more serious offence. If you were willing to take the risk, fine, but in all decency don't encourage someone else to do so.

You maybe remember the case of MP Chris Huhne who sought to avoid 3 penalty points for speeding by getting his wife to say she was driving. Both he and his wife were jailed for 8 months. I wonder if anyone said "Nobody has or is ever going to prison over a speeding offence."

Nobody is suggesting that anyone will go to prison as it stands.

But people are suggesting lying and pretending that Nan was there. Chances are, they;ll get away with it. But if they don't, then what they will be charged with is not "misuse of a blue badge" but perverting the course of justice, and that will attract a prison sentence.

The poster who said that it used to be OK to use a BB if doing a job for the holder, is mistaken. Provided you are insured to do so, you can drive a Motability car to do shopping etc. for the registered owner, but a BB is solely for the use of the disabled person, and the disabled person must not be sitting in the car while someone else nips into the shops for them, they must get out and do it themselves, as any able bodied person should park, and walk to where they need to go.

I think that as long as your Nan tells the truth OP, that she didn't know about your cousin using the BB, and she had accidentally left it in his car, she might be OK, although it's likely to depend on who deals with the case, as she is legally responsible for the BB. For future reference, can I suggest that she carries the BB in her handbag, so that she can use it whoever she travels with, and won't risk someone else using it without her knowledge.

Your cousin however, is likely to get a £1,000 fine for misuse of the BB and failing to show it to a person who is entitled to see it.

Had he told the person who caught him that he had dropped his Nan off and was waiting for her, they would have insisted on staying with him until she reappeared, so he would have had to 'fess up eventually, and of course CCTV would have proved that she was never there in the first place. I fear that this is going to be a costly lesson for him OP!

Such drama on here! Your cousin could use the badge if he was driving your nan. He just needs to say that he’d been using the vehicle to take her food shopping that day and needed the badge as she can’t walk long distances from his car. Simple. It will definitely be fine. Mumsnet is full of drama llamas.
