Can I use my deposit for next month's rent?

I'm in a tricky financial situation this month, a job I have started which I was told would have lots of hours for me is giving me one day a week by the looks of it. I'm a supply teacher so no work over summer. I usually work most of the summer holidays in care agencies, I'm still with these agencies but they hardly have any work it seems which is unusual. I will hopefully get a few days from them which will cover my rent, but there's no guarantee.
Anyway, I am wondering if I could ask my agency/landlord to use my deposit to cover next month's rent. It's not ideal, but not sure what choice I have. I have never been late in paying rent before and this is the first month ever I've not had consistent work. I feel ashamed and scared.

I am working ATM but only part-time, and the way payment dates fall means they'll fall after my rent date. Also have council tax and credit card debt to pay. So just wondered does anyone know if you're able to do this?

They can't, it will be protected in a scheme and can't be released until the end of your tenancy.

Every rental contract I ever had explicitly stated that the deposit couldn't be used in lieu of rent. Also your deposit should be in a tenancy deposit scheme, so the landlord/ agent doesn't physically have it.

Ah well, never mind :( thanks.
Fingers crossed I'll get more work this month.

Could you call the council to suspend the council tax payment for a month?

PaniniHead · 02/08/2023 11:32

Have you looked to see if you would be entitled to UC?

Ryvitas · 02/08/2023 11:33

My partner earns so we likely won't be entitled to anything, unfortunately.
I Will try to sort the council tax out. Thanks

What is your partner doing about trying to help?

AvidBookAndCatCollector · 02/08/2023 11:44

Have a look into UC. Why isn't your partner paying the rent out his wages though? Your rent is the most important bill out of any bill.

CatsOnTheChair · 02/08/2023 12:13

Will the payment you are getting just after your rent is due, cover your whole rent? And can you pay any of it in advance?
I'd ring the agency asap, and talk to them about the possibility of paying late/paying half late.
This is assuming there is no way your partner can cover the cost. If he has money, ideally he pays the rent on time.
Using the deposit isn't possible.

Cosyblankets · 02/08/2023 12:22

It'll be in a scheme and even if it wasn't it's there for any damages or whatever. You'd have to start again with a new tenancy

Thoughtful2355 · 02/08/2023 12:37

If your partner works then he will just have to pay the rent then. until your situation changes, if he doesnt live with you then you will be able to claim benefits

Lkahsvtv · 02/08/2023 12:40

As others said that isn’t an option but if you can’t pay your entire rent then pay what you can and explain the situation to the landlord. It’s not ideal but they’d prefer you pay something and let them know when you can pay the rest

ChazsBrilliantAttitude · 02/08/2023 12:44

We are LL. We’ve had tenants with cash flow issues before and, if they are usually reliable, we are fine with staged payments or a short delay. The key thing is that the tenants speak to us in advance.
