Need help, who do you report an injunction breech to?

I know IABU to post it here but need answer quickly and it’s the busiest board, name changed for obvious reasons.

Who do I report an injunction breech to? I wasn’t told when the court made the order, the part of the injunction that has been breeched has a power of arrest attached to it. There is physical evidence that the breech has taken place, I just don’t know if I contact 101 or the court tomorrow morning at 9am? Nobody explained that part to me, I have a copy of the paperwork and it doesn’t say on there, I think the court thought with the power of arrest in place they person wouldn’t be stupid enough to breech it but a week later they have.

Or would I report this to my solicitor in the morning? I’m worried if I leave it until the morning it’ll be to late to report it and they will get away with it but don’t want to ring 101 and get a telling off for wasting police time. Why the hell did I not ask this question in court the other day? I am clearly naive to think an injunction it was the answer.

For all breaches of non molestation and restraining orders my ex has carried out, I have called 101 and reported asap. Never been told I'm wasting police time. The orders are in place to protect me and my son. I would phone and report (and have done at all hours).

If there is a power of arrest attached to the specific provision you say has been breached, then report to the police showing them the injunction, power of arrest and your evidence and ask them to arrest him and bring him before a judge of the county court within 24 hours of arrest (excluding Sundays).

Don’t phone the court, they can’t do anything. If you obtained the injunction, then you could make a committal application but that does not require arrest

@Delphigirl thank you. Four sections of the injunction have been breeched this evening and all four sections have the power of arrest attached.

The evidence is time and date stamped and has been recorded automatically after motion was detected on a police issued cctv recording device fitted at my address. I would seriously hope that they accept evidence from their own equipment or what’s the point of fitting it? It is not my dh that the injunction is for by the way but there has been threats to life made by this person previously.

Yep police 101 unless you feel under immediate threat then 999.

Let the police think about proof and how they want to deal with it.

Quite dangerous IMHO to advise pausing to assess levels of proof before reporting. If this were a highly dangerous man with target hardening on OPs house then the police would want to know even if a tiny suspicion so they could be proactive.

@NightShiftDrama I don’t know, it’s witness intimidation so don’t know the individuals personally to say how they will act.

Hope you're okay @peekaboo1986 please phone 999 if you feel in danger, otherwise I'd be phoning 101 - hope you're not on hold for too long. The police have put that video recorder in place so they must have been half expecting the person to break the injunction. Hopefully they'll arrest the person on the basis of the recording etc.

You are ding the right thing OP and if they turn up again tonight I would phone 999. You can't muck about with what sounds like a dangerous and scary situation.

Police on 101 but if you feel at threat 999.

Make sure that you tell them you want the arrest. I made the mistake when they asked me what I wanted them to do about a breach because they thought it might provoke him to breach again. So I said don't do that then. The police shouldn't have said that. A breach is a breach and should be dealt with. My ex carried on breaching because the police did nothing.
