Sick benefits after separation

Hi...posting for traffic.

Can anyone tell me what would happen in the following scenario please? Husband is self-employed, as is wife. Husband has PTSD and struggling with every part of day-to-day life, including parenting, marriage, and work. Husband leaves family home for good, property is in his name but married so obviously a joint asset. If he is unable to work and gets signed off by a doctor, will he be entitled to the full amount of benefits, given that the house he owns is home to his wife and kids? So as not to drip-feed, the wife owns a flat in her name that's rented out. Does anyone know where he stands?

I'm fairly sure that you can't claim housing benefit if you own a property. He would still be entitled to the other elements of universal credit though but it's very limited income.

He won't get any mortgage help. It's a loan that pays the interest only and you're not eligible for months.

He will get single person universal credit which is only £368 per month. In time he may get put in the group that doesn't have to look for work which would give him an extra £390 on top but my friend waited over a year for that assessment and can be refused.

On £368 he won't have to pay child maintenance.

Contrary to what some believe benefits, especially for single people, are extremely low.

He can claim basic UC and sickness element UC but no rent or mortgage costs and no money for kids that don’t live with him

He won't be entitled to UC. It'll be New Style ESA and only if he has sufficient NI contributions. He could be entitled to claim Personal Independence Payment (PIP) - a non means tested disability benefit.

Are you meaning if you split up?
Pip is a possibility if he is seriously affected by the PTSD. That would not be linked to his savings and he can still work and claim. UC is linked to his income and savings so he might or might not be entitled to it. He would receive the housing allowance element of it if he was eligible to apply and was renting somewhere eligible.

Yes, the house will be disregarded for 26 weeks. In practice, former matrimonial homes can be, and generally are, disregarded for longer, and they are definitely disregarded if proceedings are under way with regard to what happens to the former matrimonial home in divorce.

He will therefore be entitled to housing costs under UC if he is renting somewhere.

And he will be entitled to UC, contrary to what @electmenow said. He will have to provide "FIT notes" up until he has been assessed for capability to work. When claiming, he needs to answer "yes" to the question that asks about an illness/disability that places him at a disadvantage when getting or keeping a job.

Well the obvious question is where is he going to live? Between them they own two properties, they need to give notice to whoever is in the flat and somebody needs to move in there
If they can't afford two mortgages they need to sell at least one property
Why should he get housing benefit as a home owner, i private rent and get no help and earn too much to get on my council housing list but not enough to be able to raise a deposit
