Another who was at fault- car collision

Bravoo · 06/07/2023 00:07

Car A- Driving along main road at speed limit of 30mph. Houses with drive ways to the left of them

Car B- (van) oncoming but proceeds to turn right and cut into the path of Car A to go up one of the drive ways.

Car A having no time to react collides with side of Car B

damage to Car A. Insurance write off. Very minimal damage to van.

Car B had dog in passenger seat. May have obscured view?

the reason I ask this is the collision was a year ago and there is still no conclusion to the claim as neither party is accepting liability

B should have waited until it was safe to turn right.

Car Bis at fault. Do you know if your insurer has passed the matter to their solicitors to deal with?

nocoolnamesleft · 06/07/2023 00:11

Car B is at fault. Had this happen to me today. Fortunately managed to react in time.

Bravoo · 06/07/2023 00:13

@BennyBlancofromtheBronx Yes, it was passed on to the solicitors a while ago but still no conclusion as the third party insurer has not paid costs

Car B is denying liability

Unfortunately neither vehicle had a dash cam and there was no witnesses.

@nocoolnamesleft glad you had chance to react.

The van driver was so quick to pull in front with no indication and it was unfortunately in my direct path. I did emergency break but it was just too close. I’m not sure he even saw me or looked

@Bravoo do you know what the other driver's version of events is?

Tbh, the solicitors should be issuing count court proceedings. However, some are more on it than others.

Also, the drive way he was pulling onto was a long one with garages at the top. He actually went up and turned his van around at the top to face downwards before coming to see me.

I was quite annoyed with his attitude. He asked me how old I was. Said I looked young and asked me how long I had been driving for. Which I guess shows he maybe knew he was at fault but thought he could get away with it. I had 6 years no claims up until this point

@BennyBlancofromtheBronx I’m not too sure what he has told his insurer, I just know he hasn’t accepted fault. His van was a company vehicle

Im wondering if they will mark it as 50/50 liability due to having not enough evidence?

I did receive a message from the solicitors saying it may go to court and that I had to submit more evidence like a diagram of the accident. I did this about 6 months ago but haven’t heard since

Thanks everyone for your replies. Do you know what will happen if it does go to court eventually? I have anxiety so the thought of it makes me nervous!

They're trying to drag it out in order to make the other insurance company just give up.

Car b is at fault. Should have ensured it was safe to turn.
