Job share hols advice needed

I've recently started a new job. It's part time and I share the job with 2 other ladies (we do half days)
One of the ladies is pretty well off financially and has told me that rather than be paid when she covers annual leave, she has the days off as TOIL.
I don't mind covering the odd extra day, I'm not unreasonable, but if I have to cover her annual leave PLUS these other days she's taking as lieu days, I'm going to be constantly covering. The whole idea of me going part-time time is to help with my Grandson and elderly Mum. I don't want to cause a fuss as haven't been there long, but equally I'd rather sort it early on.
Has anyone else come across this or have any thoughts on what to do, or AIBU?

Do one of you have to cover all A/L for the other 2 or for ofd days here and there can there be nobody?

Bluebells75 · 06/06/2023 15:51

If she is off I have to cover her Thursday and Friday morning shifts which means I will be in every day Mon-Fri.
The other Receptionist would cover her Wed morning shift.

If you tell your boss you want to take your OT as TOIL too what would happen?

Overthebow · 06/06/2023 15:55

talk to your manager and say you can’t cover the extra toil shifts as you have home commitments, and of course you can cover the standard leave shifts as per your contract.

Well this is what I think, it would get incredibly messy! In my previous employment we have just been paid for any overtime.
She's quite bossy, so I'm nervous to approach it with her !

Oh that sounds tricky and quite unfair if you have to then cover her toil .

Are you 1fte between the three you? Trying to work out how your shifts work and how much leave you’re talking about. Eg if 1ft there could be 33 days between you Inc bank holidays or assuming a 7 hour day = 231 hours or 77 hours off each.

if she did say 12 hours a week you’d be covering 6.4 weeks worth. If she then gets toil for her cover that could mean 13 weeks of working M-F every day but also what happens if you want time off when she’s on AL or getting toil?

could you compromise and cover some toil but say the frequency of having to work on nwds is not what you were expecting?

I do always find it a bit odd re cover expectations with job shares. If someone was full time they’d just be on holiday and the company would have to deal with the absence.

Bluebells75 · 06/06/2023 17:01

Yes, 3 of us cover 1 ft job.
Person 1 - 3 half days
Person 2 - 3 half days
Person 4 - 4 half days

Each time she covers holiday she wants to bank it as extra time off, but myself and the other job share will end up covering these additional days and I don't really want to cover above and beyond her contracted annual leave as I have other commitments. Guess I'll try and speak with her. I just wondered if I was being unreasonable

What does your contract say? I am part time and I am not required to work extra hours just because somebody else is on holiday, that is quite an unusual arrangement.

I am contracted to cover her annual leave, and her mine, which I'm fine with and has been normal in my previous job share roles. My issue is her banking days she covers my annual leave, in effect giving herself more holidays - which I'll then be expected to cover 😬

I'd have a conversation with your manager and make it clear you can only work overtime to cover ordinary annual leave as per your contract not TOIL.

Them awarding TOIL instead of overtime is a management issue, not yours.

thing47 · 06/06/2023 17:35

I agree. TOIL days aren't part of her annual holiday allowance so you aren't obliged to cover them, contractually.

But I think your complaint is aimed at the wrong person @Bluebells75 – your colleague hasn't actually done anything wrong here, she has made a request and it's been granted. You need to explain to your manager that you are not available to cover colleague's TOIL days.

Yes, you're right. Management are allowing this, so I'll have to say it was my understanding that I would cover annual leave only.
I just didn't want to sound moany early on, but I guess I have no choice than to try and resolve it sooner rather than later.

I'd point out to your manager that this doesn't work, unless I am missing something.
You haven't said if the same applies to the 3rd person in your group, I will assume not for now. If you wany TOIL too as you have caring responsibilities then.
If on week 1 Person A goes on holiday for her 3 x 0.5 days and you B cover
Then next week you could have 3 x 0.5 days off as TOIL instead of extra pay and A would have to cover
The the next week Person A would be off for 3 x 0.5 days as she covered you last week and you would have to cover so work 6 x 0.5 days
This would then just repear so actually you were working 1 week 6 x 0.5 on 1 week 6 x 0.5 off. Until another holiday period and then it would get even more complicated.

Any HR staff on here who may know the answer?
