Ex dp, pays £30 a month for 2 dc as he gets universal credit. He's self employed. Now if you are Self Employed UCs assume you are earning NMW x 35 hours (for adult with no resident children) so £1458 a month. Yet because he gets UCs I only get £30. Now I don't know the ins and outs of all his and his partners (who works for ex dps company self employed too) finances, but surely something doesn't add up? Bought house (not sure about mortgage, apparently it was gifted to his partner) They have no dependent children living with them so not even sure how they get UCs. It's so unfair that he gets away with £30 a month.

MIF = minimum income Floor BTW.

realy they should look at his company finances a little more closely. Whether he’s paying his employees a fair rate and whether there is hiding of assets. If he’s hiding money he’s probably avoiding tax too. Wouldn’t they have to claim UC jointly though? Or are they not living together?

RandomUser54 · 02/06/2023 15:22

Yes it's a joint claim

Contact CmS. Ask them to include his dividend payments.

CMS are a nightmare to deal with but they should be able with this. (Unless he's working for cash, in which case you've got no chance)

PensionPots · 03/06/2023 08:53

Is it the kind of business where he can be paid in cash and not declare it as it’s a service.

RandomUser54 · 03/06/2023 10:34

Yes it's a trade, they do get paid via bank/paypal etc but cash too.
Unless he's savvied up a lot, he won't even know what dividends are.

Do UCs take dividends into account?

Could be worse my ex is on UC but doesn’t have to pay as he has “priority debts” 🤣 I’ve given up ever getting anything for the children. Closing my claim they are useless.

I don't know anything about UC. But dividends are income, so I would think so.

CMS don't automatically take dividends into account. You have to ask them.

There is a Facebook group called 'child maintenance service UK - questions, answers, advice and support'

There are loads of very knowledgeable people on there who could probably help you.
