Can an Unreasonable Nosie Abatement Order infringe human rights?
If so what human rights are they infringing?

Because the level of noise that is being complained about appears to be quite low, but a noise abatement order has been issued

would an a abatement order infringe basic human rights for being able to live in a house if it was overly and unfairly and unreasonably restrictive?

It would be very unlikely that an noise abatement order would be issued for noise which isn't noisy!

You need to stop being noisy basically.

Hard to say without knowing the ins and outs but everyone has the right to peaceful enjoyment of property. Guessing someone feels youve infringed that right

I agree it is nobodys right to make unreasonable noise
or a human right to make an unreasoable noise

wrt hiuman rights I am not sure whether it would infringe human rights because I dont underatand enough about that aspect of the law, apart from things like freedom of speach and things like that

wrt nosie levels, we all make nosie and ambient nosie levels are one thing, screeching in the middle of the night is obviously not ok

when living in a terraced house or non-detached house tv playing can be an issue for example

A tablet or a trumpet?
The former is easily solved by headphones. The latter could only be acceptable in a terraced property for an hour or so a day, and even that would be a challenge to live next to.

FFs if you are making noise which is upsetting neighbours just stop. Headphones wd solve it. I mean why wouldn't you? Or do you think you have a right to piss people off. If the noise is neighbours and you are the complainer then you have what you want with the NAO so it's just a question of enforcement.

headphones would solve the problem agree
but I dont think that is a reasonable solution for all ppl living in non-detached houses
and I am sure most ppl dont watch tv as a family all with their headphones on
unless those who are suggesting that do just that

Sorry but one we couldn’t get a noise abatement notice served for repetitive loud dog barking as they weren’t barking “for long enough” so your volume must be really something…

Its a 10.5 inch samung tablet, max noise coming out is 75-80dB when right next to it
noise levels dissipates with distance and walls etc,,
70dB regarded as loud talking
so would expect the noise to dissipate through a terraced wall by some anount
60db regarded as quite talking

On the face of it just based on a tablet being watched that does sound excessive.. but it that seriously all it is?

In my with noisy neighbours it's unbelievably hard to get anything to happen. So I'm sorry but I absolutely do not believe the tablet is the issue here. I also think that normally somone would measure the noise in the affected home before this order is issued.

If it is then I'd be concerned that the complainant has told some porkies to the council.

that is a reasonable view on the face of it for sure
agree that the noise in the affected home would have or should have been measured
but that pre-supposes that there is a reasonable level of sound insulation between the houses, which I dont think there is
