I was over by five minutes- I know council ones give grace period of ten mins but these camera recognition on private one? I was in my husbands car and we can’t afford the 100 pounds. Anyone gone over and not had one or know the law?

I don't know any carparks at all that give ANY grace period!

bluebeck · 19/05/2023 14:22

I’ve never known one give that extra time, but good luck!

woodhill · 19/05/2023 14:23

They give those annoying permanent leaner delivery mopeds 10 mins grace where I live

Hope you get it sorted out OP

I would assume they'd refer to their T&C's of using the carpark- which would state 60mins, not 65mins or 70mins!

I always set an alarm if I'm parking somewhere with a time limit. Best of luck.

Don't sweat OP, there's a compulsory 10 minute grace period. If they do try to fine you, you can appeal.

There's a whole load of other grounds for appeal too. DP entered his registration number when he went somewhere in my car and, when we realised the mistake, we appealed and the fine was written off.

The Private Parking Code of Practice | March 2022 | POPLA

The Government published new Private Parking Code of Practice on 7th Feb 2022. Parking operators will need to fully adhere to the Code ahead of the launch of the single parking appeals service in 2024.

The only ones I've known with a grace period are where you pay for your exact time period when you return to the car and get 15 minutes to actually get out of the car park. Never known one where you have paid and displayed.

MuffinToSeeHere · 19/05/2023 14:24

They don't give you a grace period for being late back so they? The only grace period I've ever known is for multistorey type car parks with machines where you pay on the way out, where once you've put the ticket in and paid you've got about 10minutes to leave the car park to account for any queues.

I don't know but I still remember running through a car park with baby dd seeing the parking attendant approaching my car and him saying "Don't rush. I always leave cars with baby seats til last." It was 20 years ago, and I can still remember his face.

Socktupus · 19/05/2023 14:27

I would google the actual carpark or the enforcement company. There might be a facebook group specific to the place where you parked.

My brother is an UBER driver and currently has twelve parking fines from one carpark as there is a McDonald's in it and he's in and out all of the time. The letters are brutal and the fines have now been sold to a bailiff company.

My brother is waiting to go to court as he has evidence from his UBER app that he wasn't parked there but they say he could have been using a different vehicle.

However...he didn't do it. He wasn't parked there and he still can't get off with the fines.

The other problem is they have seven years to take you to court.

British Parking Association Approved Operator Scheme
Code of Practice
Control and enforcement of parking on private land and unregulated public car parks

13.3 Where a parking location is one where a limited period of parking is permitted, or where drivers contract to park for a defined period and pay for that service in advance (Pay & Display), this would be considered as a parking event and a Grace Period of at least 10 minutes must be added to the end of a parking event before you issue a PCN.
13.4 Unauthorised motorists will not be entitled to the minimum time period of 5 minutes for a consideration period in spaces designated for specific users e.g Blue Badge holders, pick up/drop off or where parking is prohibited such as
hatched areas in front of emergency exits, or on entry and exit ramps etc.

BarbaraofSeville · 19/05/2023 15:25

I posted that upthread an hour ago, but my post is hidden amongst all the many posts insisting that there is no such thing as a grace period........

Camillasfagwrinkles · 19/05/2023 15:25

I don't know of any grace period in car parks.

Catspyjamas17 · 19/05/2023 15:29

Well you don't know much then.

They at least have to allow you time to read the terms and conditions, decide whether you want to park there then go and get a ticket or leave.

I parked in a car park today for two minutes. My daughter then called from the dentist saying she was done and I picked her up. In that time the payment app had not even opened on my phone, as it was a shit phone data area.

Lennon80 · 19/05/2023 21:52

Right so given this

13.3 Where a parking location is one where a limited period of parking is permitted, or where drivers contract to park for a defined period and pay for that service in advance (Pay & Display), this would be considered as a parking event and a Grace Period of at least 10 minutes must be added to the end of a parking event before you issue a PCN.

I should be okay? Definitely wasn’t more than ten mins. I wonder if the sly things will issue them anyway just because people don’t know this? Or those camera recognition things only issue an over stay after ten mins ?
