Neighbour argument

Hi, I'm not sure where I stand so I thought I'd pop on here to hear any other points of view. My husband used to work onsite and goy all of our fencing for our garden for nothing and also got lots of extra fencing for our attached neighbour so he could do the rest of his garden too. Since then my neighbour put raised beds in and filled them with soil and planted big bushes in that have obviously grown. Now my fence is being pushed over and is just about to drop. The neighbour admitted months ago it was the soil pushing it over.He now says he will put 3 new posts down my side of the garden fence to try and push it back over. I have a small narrow garden and the posts were put on his side, according to him he agreed to that because we had supplied all the fencing. To have the posts put on my side is going to make the little bit of my garden look even worse. I think as it's his soil and bushes that have rotted the fence posts he should have to fix it from his side. We bought our home 6 years ago and found out on the deeds that he has taken a bit of our garden anyway when the old lady ived here before us. My husband left me last year and I think this neighbour thinks he can bully me into having posts put in my side sothay he doesn't have to sort out the problem. Any advice would be great thanks.

Get concrete posts put in. They don’t rot and fall over. We replaced all of ours with concrete ones.new panels slot in easily so can be replaced easily if needed

Hi @Dodie66 Maybe I can suggest that to my neighbour, but that doesn't give me a solution as to who's side of the fence the posts are put on, thanks

Our fence posts are between the fence panels not to one side. Wouldn’t that be an option

Suggest the concrete posts with a concrete slab at the bottom, to hold his soil back, to replace the wooden fence

Just use concrete gravel boards for the bottom part and concrete posts then they won't need to be on anyone's side and will hold the soil back. You can slot more than one row of gravel boards into the bottom of the posts so it will be high enough to hold the soil and it won't rot because the wood will be above it.

Firstly reclaim your land back. CF should NOT be getting away with that. Use a lawyer if you have to.

Secondly use concrete posts, they go on either side of the fence panel and are much better and longer lasting over all.

I wouldn't be fussed on the fence thing. Let it fall over and be his problem.
I absolutely would be claiming my land back though!

HI if the neighbour has taken some of your land you need to act quickly as there is a limitation on the time you can raise this.

@Lou197 I think the time has probably passed, all I want is him to fix the problem but he says he is not taking the bushes out and if I want it fixed I will have to have new posts on my side. To be honest I'm not sure why he thinks that will sort it, the fact that he piled god knowsw how much soil in a raised bed is whats causing the problem.

Then sort the fence out.

Take it down, get concrete gravel boards for the bottom and remount the fence on top. It will probably cause his precious plants lots of problems at having all the concrete put in but that's tough!

I don't get the issue with posts on my side.

If you really want to p*ss him off then as it's your fence you can paint it any colour you like. Pink with yellow dots in memory of Mr Blobby?

Don't let him "fix it" without getting a professional opinion, he's just trying to fob you off. You're probably right that new posts won't fix the issue of the rotten panels, and if he doesn't remove the raised beds he's just delaying the problem.

If you let it collapse or remove the fence altogether, it won't help your situation but it would make the raise beds collapse no? So a good lesson learned for him?
You might want to post this in Legal Matters, I'm wondering if you could claim some of the costs back to him to replace the fence if you can prove that his actions caused the fence to rot...
