Who is responsible for paying for damage

A few months ago we had work done on our roof. The company who did the work on the roof hired a scaffolding company who damaged our property.

Since then no one seems to be taking ownership to rectify the damage to our property.

I think the company who did the work on the roof need to pay for the damage and then seek the payment back from the scaffolding company (considering it was them who hired the cowboy scaffolders).

Roof company keep saying they are contacting scaffolders but they're not responding.

So months have passed and all swept under the carpet.

So who is responsible for paying, or do we get it done ourselves and send who the invoice?

Report the damage to your home insurers. They will likely arrange the repairs then make a subrogated claim against your builders and/or the scaffolders. If both companies are decent, they will have Public Liability Insurance for just this type of incident.

You should always inform your own insurance company (home, motor etc) of any incident which could give rise to a claim, even if you aren’t at fault and even if you don’t believe it’s likely that any claim will ultimately result. It protects you from potentially being denied coverage for delaying reporting, particularly if there has been any renewal in the intervening period.

Thank you as never thought to do this. The cost to repair damage is very minimal, probably £80 to replace, but the fact no one gives a damn is annoying me.

just a personal opinion...

Yes it's annoying, but I'd just short pay the builders by £100, they can deal with the scaffold guys if they want to. Their problem, they contracted them.

I wouldn't involve the insurance company for something so tiny.
