To think the person that hit my car should pay for it?

I don't understand car insurance - I'll start with that.

So my car was parked - and hit by a van - who just drove off!
Luckily it was outside my house so I have clear CCTV of it.

I only had third party party insurance (I now know that was silly)

Anyway - I contacted my insurance to notify them. I couldn't claim with them, but they were very helpful and passed me onto Enterprise (the rental company) who said they would pursue a claim against the van divers insurance.

I've just chased them up, (Its been a month), and they've said that they contacted his insurance company - but they haven't responded, so its now "out of their timeframe"

So .. he just gets way with it? :-(

Hard to see why Enterprise would. They wouldn’t get anything out of this arrangement?

I think Enterprise now also run a claims management division seperate to rental.
A friend recently was in an accident where they got involved

You should have had fully comp. I am always baffled about how many people don’t read what they actually have insurance wise

Believe me, the driver will almost certainly not get off with this. As you've reported it to police and have proof, they will more than likely get a summons, and potentially have many stressful and expensive months ahead of them leading up to at least a fine and points on their licence.

When my parked car was hit by a van that failed to stop and was written off the police did absolutely nothing about it at all and just wrote to me and said the van driver had insurance and they will sort it out. Van driver denied it completely. I had an independent witness to the accident who ended up having to go to court and his insurance did pay it in the end but it took ages and I doubt think I'd of been able to pursue it without my insurance company doing everything for me. At least I was fully comprehensive so everything was paid by my insurance company while I was waiting.

Third party insurance only covers damage to someone else's car that you cause, not damage to your own.
Did you take out legal cover as part of the policy- check to see if it is on your documents. Can't remember what ours is listed as but years ago it would sometimes be listed as DAS. ( IPT is insurance tax which is different).
If you do have legal cover they will pursue a claim for your uninsured losses so ask your insurers to refer the claim to the legal cover provider, or fir the details of the legal cover so they can pursue claim on your behalf.
Uninsured losses are anything your policy doesn't cover, so in your case damage caused by a third party that you are not insured for, or things such as an excess someone has to pay.

Yes but you personally have to chase, your insurance company doesn't get involved when it is 3rd party!

Yes, I know. That's why I'd have taken details and presued it.I take pics too.

I've not read all the responses but when I was pranged in a supermarket carpark I took my car to a repair shop who were able to use the vehicle registration I had to look up their insurance to pay for the repair. HTH.

We had our property damaged recently by a car driver who refused to provide insurance details. It was the fault of the driver.
My husband looked up the driver's insurance company and wrote to them including supporting documentation such as the cost to make good the damage, and a report from an independent witness with contact info.
The insurers came back with a few queries about the damage before settling the claim for cash.
The police provided a reference number but that's about all they did, it should have been prosecuted and still might be when we get round to complaining about it.
We didn't use any third party companies, just got the details from a database online which cost maybe £10.

Then maybe it depends on the police authority in question.

I also work in insurance. What other posters have said is true regarding the third party insurance as you didn't cause the accident.

If you don't make any progress make a formal complaint with your own insurance company as they have a duty of care to you. They have 8 weeks to investigate your complaint and try to reach a reasonable outcome, otherwise you can go to the financial ombudsman. Obviously it may well take longer than 8 weeks for them to claim the money back, but as you have clear evidence that the damage was caused by a third party and who that third party was they should be working harder to recoup the money on your behalf. They should be doing the work not fobbing you off.

I am unsure what enterprise has to do with it, as far as I am aware they are a vehicle rental company. But if the van driver was the one driving a rental van they still have to have insurance and enterprise should still pay out. Unfortunately car hire companies are notoriously unscrupulous so it would seem they have fobbed you off. Again same process of make a complaint, follow it up, if that fails go to the ombudsman. Sorry you are having a rubbish time, not all insurance companies are like that I can assure you.
