Issue with car sale

I've just sold my older brothers car (which I was using for a few weeks) as a favour to him on carwow. They came to collect the car and they did an inspection (everything was reported to be fine). They then transferred RK ownership and the monies to my brother's account as it's his car and he was the RK.

Upon leaving the driver then noted a 4 inch linear crack in the windscreen, the car is pretty dusty tbh and I hadn't even noticed it myself. He didn't make an issue but sort of implied I should call the dealership and tell them and see if I can pay back some of the money for the crack. I asked him if they'd contact me about it, but he said that as the money transferred it's a done deal now. He was saying that as an act of integrity I could call them and let them know.

I feel slightly guilty as I wish he'd noticed it first when he was supposed to check the car. Spoke to my brother and he's not happy to go through the process of refunding it back partially and says it's the collectors fault for not checking properly.

The person collecting didn't imply his job etc would be on the line, but I feel guilty as he may get in trouble/ have to pay the costs. Also he knows where I live, so slightly concerned he may come back and do harm Beef style (a bit farfetched I know).

I'm at a quandary as to what to do.

YABU: you should take the initiative and pay the windshield costs

YANBU: it was the collectors responsibility to check the car properly first.

4 inch crack probably MOT failure and also possibly not repairable depending where it is.

A 4" crack in the windscreen isn't something that is easy to ignore. Was it you that put it there or was it there when you borrowed the car for a few weeks ?

Ultimately they have your brothers address (the RK?) so they will go to him to sort it out if needed.

And then you and your brother have to sort out between yourselves who is responsible for the crack ?

You’re overthinking.

trickyfriendsone · 19/04/2023 15:44

Surely it's sold as seen.

If you honestly hadn't noticed the pretty significant crack you have nothing to feel
Guilty about, the car should have been checked over properly before agreeing the price/money transfer.

If the person collecting had driven away before noticing the crack that's on them.

They inspected it and paid the value they felt a vehicle in that condition was worth. If they didn't inspect it properly that's their problem. I might feel differently if it was a private sale because the buyer would not necessarily know what to look for, but a professional inspection should pick up a 4 inch crack in the windscreen, even if the window is dusty.

Hmm, I think a 4" crack is pretty hard to miss but if they didn't see it when inspecting in, can you be sure it was there before pick up?

Car dealer here... If our driver missed something like that then we just take the hit. It's the driver's fault, he should inspect thoroughly and only then request funds get transferred. Our driver has a really long check sheet to go through and has to tick everything off.

What he'll probably say is that something hit the windscreen on the way back to the dealer. I wouldn't worry.

Yanbu - not your problem now funds have been transferred

Thanks all. I mulled over it and left it. Re: the scratch, it could have been me or my brother!!
