A man who raped a 13-year-old schoolgirl in a park when he was 17 has avoided a prison sentence.

Sean Hogg, 21, attacked the girl in Dalkeith Country Park, Midlothian, on various occasions between March and June 2018.

Judge Lord Lake said that if the offence had been committed by an adult over 25, Hogg would have received a jail sentence of four or five years.

Instead he was ordered to do 270 hours of unpaid work.

Court papers stated Hogg, of Hamilton, South Lanarkshire, threatened the girl, seized her by the wrists and forced her to carry out a sex act before raping her.

I agree it is sickening given the details of the offences. That guy should be behind bars.

The reason for the sentence is that the offence was committed when the offender was under the age of 18 so he is being sentenced as a minor. Also tThe judge is only following sentencing guidelines which strongly recommend rehabilitation rather than incarceration. I disagree with those guidelines but anger needs to be directed to the Scottish sentencing Council which is the body which writes those rather than the judge.

Those guidelines are ridiculous - I understand the desire to shift to rehabilitation, but some crimes should be excluded from that and rape is one of those.

Is rape basically legal now? Terrible time to be a woman, feels like society is regressing.

I always hear that the death penalty isn't necessary because sentences for things like murder and rape mean that the guilty are locked inside for many years as an alternative punishment but it seems like now liberal judges don't seem to even want custodial sentences for terrible crimes and they seem to view criminals as the real victims. Rape convictions statistics are dire and even when they are found guilty they either get let off (as in this case) or get a few years and then let out. The system really seems to hate women. It's horrifying.

Rape is pretty much decriminalised nowadays.

I don't know of anyone, male or female who think this is an acceptable punishment. The fault seems to lie with the SNP's (that's the party that had a woman in charge at the time) sentencing guidelines and the judge's interpretation of them.

It looks like the defence team are appealing (staggeringly enough) and it also looks like the Crown Prosecution Service will also be looking at this as its way, way too lenient.

I'd expect the bastard to be locked up soon enough.

This is nothing new. I’ve seen a few threads on this in the last few days, people quite rightly up in arms over it. But it’s been going on for absolutely ever. It’s something like 410 men have been given non custodial sentences, community sentences or complete discharges - even though they were convicted, yes really - since 2011.
Not sure if figures are readily available for before then but I can’t imagine it being better. So, yes rape away, there’s an absolutely excellent chance you’ll get away with it.

It seems that at 16 you're old enough to vote and change gender in Scotland but not old enough to be criminally responsible for raping a child. It's sickening.

Yeah honestly she must be wondering why she bothered - community service and sex register for 3 years after a harrowing ordeal and a 4 year wait for a court case. And they wonder why people don’t report rapes. If you know if they were u25 and they might get community service…

It was his first offence wtaf, that's not a defence. This case needs reviewed for leniency and a prison sentence put in place. Community order is a joke. Smug little bastard should be in jail.

I really hope this pathetic sentence changes things but I’m not going to hold out much hope, we really are second class citizens.
