Has anyone had to get a it order to take child on holiday?
was it difficult? How much roughly did it cost?

and is this then permission for any future holidays or one specific one?

thanks

@Ksisusbshau A child arrangement order costs just over £300. You can represent yourself in court. You will be awarded it as your ex is being unreasonable and acting against the best interests of the child. This will allow you to take your daughter out of the country for up to 28 days as your daughter is living with you.

Don't do this without one as you would face child abduction charges which a vindictive ex would be only too aware of.

For those jumping down my throat.@YetiTeri it was obviously a typo which should have said 'can' instead of 'can't', otherwise, why would I also say yes, it costs money to go to court. If I was telling her she couldn't go to court, why would I even mention that it costs?? Was i was basically saying, no you can't go to court but it's going to cost you money for the privelege of not being able to go. Doesn't make sense.

So wind your neck in before being so bloody superior

YetiTeri · 03/04/2023 18:28

It wasn't obvious at all @gingergirl70. You knew what you meant, no-one else did.

I wasn't being superior, I was highlighting the risk in giving out incorrect advice.

Gingergirl70 · 03/04/2023 18:37

@YetiTeri you could be a politer, there was no need for the way you said it. And I think if you'd read it properly about the costs bit, it might have been a little clearer it was a typo. You weren't poliely highlighting a risk at all. You're obviously just one of those people on MN who like to talk down to others and flex your muscles, trying to show you know more than others. Don't mistake me for someone you can treat like that.
Now, let's not hijack the OP's thread any more. I won't be interacting with you any further

We don't have a child arrangement order, we are currently in mediation atm and have agreed over the contact. It's the holiday specifically he is not giving permission for

Why is he refusing op?

My ex refused a holiday. I applied for a specific issues order and (sensing the utter knob-headed-ness of my ex) gave me a residence order that covered all future holidays up to 28 days.

Was very straightforward. Get the form, fill it in, hand it in with the fee. No idea how long it will take but the court clerk should give you some idea.

Good luck op.

You can go court for a specific issues order. Does your ex know the dates of the trip? I'm taking my kids abroad this year and they have no contact with their Dad and there are no orders in place. From what I've been told, no one will stop me?

They can stop you and refuse travel.

I've been stopped twice and had to show all my documents. You do hear horror stories of parents being stopped at passport control and not being allowed to go on holiday. Not worth risking for the sake of a couple of hundred quid in court costs.

I’m a volunteer leader in Girlguides. A Dad refused permission for trip. Mum took it to court - we supplied copies of all risk assessments etc. She succeeded but I believe it cost her £8000 in lawyer and court fees. He was being totally unreasonable - saying mum was being reckless signing girl up for trip that another 150 girls her age were going on.

Were there boys identifying as girls on that trip? As a parent, I wouldn’t give permission for my daughter to go on an overnight GG trip either!

Dixiechickonhols · 03/04/2023 19:03

No all biological female.
It was a more basic allegation that no reasonable parent would let a girl aged 11 or 12 go on a trip abroad. But 150 others were. It was a fully organised/risk assessed/insured trip to EU country.
Judge had no hesitation approving. I’m not sure why costs were so high, I know it was very acrimonious.
