To query holiday calculation

I'm due to return from maternity leave and my manager has agreed to let me take my accrued leave at the end of my maternity, as well as granting a flexible working request.

How agreeable my manager was came as a surprise as I got the impression prior to commencing maternity that there was bad blood between us (although perhaps I was wrong and it was just my interpretation).

Anyway, I had calculated how much annual leave I took in the 21/22 tax year prior to the meeting and from my calculation I still had approximately 60 hours to take. During my meeting my manager informed me that their records indicated I owed the company 52 hours, so 52 hours would be deducted from my 22/23 entitlement and the remainder would be how much I had to take. Taking 52 hours off of the current year's entitlement rather than adding on 60 means I am short by around 110 hours from what I had predicted.

I'm a bit nervous to upset the balance given how reasonable my manager has been, but at the same time with my flexible working request, 110 hours difference is about 6 extra week's worth of leave. This isn't a small company and so it's not like my manager will personally lose out if my calculation is the one that's correct, but it's the awkwardness of bringing it up I'm concerned about.

Would I be being unreasonable to query their calculation?

Just ask to see their working as they differ from yours.

Yes ask to see how they worked it out - you are legally entitled to continue to accrue entitlement during Mat Leave so perhaps they have made an error and not done that.

I work for a large global company and being big definitely doesn’t mean they are always right!! Ask to see an explanation of the calculations. Does your annual leave year run to the tax year?

Are you allowed to carry your annual leave entitlement over from previous years?

I have to either take my annual leave, sell it (but that has a deadline date), request to carry it over (I wouldn’t be allowed to carry 60hrs over, 20 hours max) or lose it.

Yes it does. The system that's used is such a mess, for example if you work overtime on a day where you should have annual leave then if the annual leave is not moved to a different day that you'd ordinarily be off then it's not counted as having been taken.

I was off sick due to hyperemesis at the end of the 21/22 tax year so I didn't get the opportunity to take outstanding leave for that year, and my research suggests this should mean I can carry over [60 hours]. I am wondering whether the system hasn't factored that in (presumably carrying it over with it being an exceptional circumstance would be a manual adjustment) and so the hours I've calculated have been automatically lost.

Have you looked at the policy, you can carry it over but often if you’ve taken the correct channels to do so and within the correct timeframe.

You could ring HR and ask them? Bypass your manager? Their new found cooperation maybe due to the fact they failed to remind you of their annual leave policy.

Double check the leave you carried over was counted. I've had to carry leave over in similar circumstances and it had to be cleared by director level as we could only carry 5 days over but yes absolutely do ask and explain your recordings.

Policy can't override statutory rights, so if you couldn't take your holidays due to sickness they have to allow you to carry over up to 4 weeks to take within 18 months.

As others have said just query it, maybe say you know the system can be a bit hit and miss, give them your workings to avoid them giving you a standard "we've double checked and it is correct" response

I can't see how you owe holiday as you will have accrued it the whole time and you can't take it during sick leave or maternity leave so you wouldn't be using your accrued holiday.

Maternity leave is protected leave so all your leave will carry over. You can't lose it because you can't take it while on Mat leave.
