Criminal injuries compensation ??!!

Hello all

Many of you will remember previous threads about criminal court and an abusive ex who tried to kill me

Surprise surprise he got off Scot free
What a shocker 😳

Anyway friends said I should apply for criminal injuries compensation

I have sent off a few things to them and now starting to wonder what the point is??

A few pound would cover valuable therapy I can't now afford

Some family say I may get 100/200 pounds if lucky (my injuries were broken ribs , wrist broken etc)

Anyway just wondering if it's worth pursuing or just a waste of energy ??!!!

Please go easy on me I'm just wondering that's all

I got £3000 (I think, was a long time ago) for a random assault which fractured my cheekbone

I need long term therapy due to ptsd
Also single parent and he doesn't pay a penny but of course gets away with it all the fcker

Ok so I may just send as much off as I can as it's worth a shot

Even for a years therapy if lucky enough

If your claim is accepted, then your injuries would attract an award higher than a couple of hundred pounds. Probably around £4000 depending on prognosis.

I received £4500 in 1990 for an assault. Awards do tend to be lower than say for an injury caused by a motor accident.

Especially as I ended up missing work and paid thousands for a flat I couldn't live in 🤦🏼‍♀️🤦🏼‍♀️🤦🏼‍♀️🤦🏼‍♀️

Definitely do it OP. I won’t specify the amount but I got compensation for a sexual assault that wasn’t even prosecuted

Your physical injury will attract an award (broken wrist). The compensation amounts are set so if you've had 'substantial recovery' then you're looking at £2400.
If you've had mental trauma, then this will also attract an award but this goes beyond you saying that you need help. You need to have a disabling mental injury (6 weeks-permanant, again attracting set awards) and this needs confirmed by prognosis by a psychiatrist or clinical psychologist. They'll ask for all your medical records then a decision maker will consider if the evidence meets the standard. If not, they may refer to in-house psychologists to assess on balance of probability.
This part can be very draining as you may find they ask you to attend assessments etc. Awards range from £1k-27k, depending on how disabling the mental injury is judged to be.

Some claims are quick, other more complicated ones take years. If you contest the initial offer, you will have to go to review, then appeal via the tribunal. This process takes time as there's a huge backlog.
Even at appeal with the tribunal, they may make the decision to adjourn for more info so really you have to be prepared for 2 years + if your claim is complex.

OP I'm going to apply next week, according to that calculator I could get about £30k. Was it difficult to apply?

Am also a single parent and the fucker doesn't pay a penny. Having endured years of abuse, isolation, coercive control and repeated rapes, I'd prefer justice but at least I'd be able to pay off the debt accrued due to the abuse (and solicitors fees to divorce the bastard) and pay for therapy. Might be able to have the heating on a bit more too!

Got a letter in the post for more info

Then sent me medical notes from the doctor

So def do it !!!!

This is interesting. My son was attacked last year as he was walking home. He got a broken wrist and lost his job as a casual labourer because he couldn’t work with a broken arm. He reported it to the police but they never caught the guys who did it so I always assumed he wouldn’t be able to apply for any kind of compensation - but it looks like he can.

You cam also apply for loss of earnings as well, but you need to have been in work at the time of the incident and be able to prove this through tax and NI revords or payslips. You also need to show causative link, so the reason you are not working is directly linked to your injuries rather than for caring etc.. loss of earnings goes from the 26th week after the incident, so you'll receive nothing for the first 6 months you didnt work and then stat sick pay for remaining weeks.
Loss of earnings is a difficult battle to fight but if you send in EVERYTHING at the start of your claim (GP records, hospital record, private therapy records-all done free by asking) and your employment proof, you'll safe yourself bags of time as they won't have to send out letters and wait for responses.

If there is a police record of the incident, then you absolutely can apply. Prosecution is not necessary to get compensation

Advice is do not apply through the claim companies. They take 20-30% for doing absolutely nothing you couldn't do yourself.

All I will say is reign in your expectations. That calculator is to tempt you to use the solicitors, it will not be a true reflection of the amount. Apply direct -the process is designed so that anyone can do it

I was sexually assaulted as a teenager nearly 40 years ago by a stranger who was never caught. I got £3.5k which would be worth over £10k now I think.

I claimed through the Criminal Injuries Compensation Scheme, which the police told me about. I filled in a form, gave lots of detail, but I don’t recall any solicitors being involved.
