Ebay - can he legitimately complain?

Sold a coat on Ebay. It was a men's coat, very large, 48". I stated the size in the title and the description. Showed a photo of the size tag on the coat. Put a screenshot of the size guide and highlighted the size measurements. Seller has messaged to say coat is much too big and wants to return it.

I do not accept returns as stated. AIBU to say sorry, no, size was clearly stated? And can he legitimately say item not as described? Coat was a 280 coat, worn once, sold for 120.

Even if you don't accept returns, buyers are able to return an item if they claim it is not as described.

Yes but in this case it is as described.

catandcoffee · 12/02/2023 19:52

I used to sell on ebay. Get the buyer to return at his cost.
You get all fees returned.
It's amazing how many people don't own a tape measure or get confused between inches and cm.

Looks like OP's buyer found her thread!

nope, that posters just a knob

AFAIK,m Ebay keeps the final valuation fee & levies additional penalty if you lose a dispute with a buyer. I truly advise that you do not advise raise a dispute with the buyer.

Ebay holds payment now until item delivered

Er no they don't

namechange9374 · 12/02/2023 20:23

Agree contact EBay customer service.

Also if you have anymore items to sell I would try Vinted. They charge the seller no fees and in most cases no returns. Unless the item is not as shown/described.

eBay don’t penalise with additional fees on a dispute

(a seller can end up out of pocket, but eBay fees are taken as per the published rates, any refund results in a fee adjustment)

Er no they don't

eBay handles payments now rather than PayPal and new sellers can have their balance witheld for a period

Yes but they don't hold on to the payment until items are delivered do they

CatchHimDerry · 12/02/2023 20:30

This sort of thing is why I no longer use EBay, that plus their extortionate fees

At least buyer seems reasonable

Yes, they can do. I haven't sold for ages so they've put a hold on the payment until confirmed delivered.

Yes. It depends on the sellers history, and will most likely affect a new seller, one who has not sold for some time or for high value items

I lost a not-as-described case, ebay kept the selling fee & added a penalty fee because I lost the case. That was a while ago. Glad to hear that it's not so horrible now for sellers.

With some investigation it turns out that this does exist and is still in place

It isn’t part of the eBay dispute process, but occurs when a chargeback is raised by the buyer through their bank etc
In the US it’s $20 and in the UK it’s £16.88 (I don’t know whether that may or may not vary on the exchange rate)

If a dispute is raised in the ‘proper’ manner through the eBay dispute process with each step followed as a back & forth then there is no fee - just a refund or no refund, and the fees adjusted appropriately

If a dispute is not raised but the buyer makes a chargeback and eBay ultimately step in finding against the seller then a charge is raised

www.ebay.co.uk/help/selling/fees-credits-invoices/fees-private-sellers?id=4822

The ‘solution’ is to ensure everything is documented, and to also do all you can to make a problem seller click onto the dispute process

Tirednest · 13/02/2023 17:51

Thanks all. Haven't heard from him and the money has been released from Ebay, so hopefully that's the end of it.

What did I do that was the not proper process, tommika?

I don’t know.

But the chargeback fee that they do have listed is where a buyer makes a chargeback from their bank etc - that being the buyer not following the dispute process. If that was the route taken then there isn’t really anything you can do as it’s the buyer who initiates a dispute (the seller can only raise a non payer dispute case)

Sometimes buyers start their ‘dispute’ in the contact seller messages, which can be deliberate to avoid the ‘proper’ process or just that’s the way they initiate

If there’s ever a problem then it’s best to refer a buyer to raise it in the dispute process which gives them the categories to raise their problem and to give what resolution they expect (return & refund, part refund etc), gives you as seller the response options and is a formal process with response items etc

Obviously I don’t know the circumstances of your case, but having searched it I have found the chargeback fee. It implies to me that they put in a chargeback claim through their bank/card and then you lost to eBays follow up

lljkk · 13/02/2023 21:36

I think the process was different when I had my problem, years ago TF. The info said it was a deliberate penalty set against sellers when seller loses a not-as-described case. This charge would be applied if any seller lost such a case. Nothing to do with an extra charge from buyer's bank.

Warszawa · 13/02/2023 22:50

Yanbu - the size of the coat was clearly stated in the title, description, and with a photo of the size tag and size guide. You were transparent and thorough in your listing, and the buyer should have taken the time to properly assess the size before making the purchase. While it's understandable that the buyer may be unhappy with the size, it is within your rights to stand by your no returns policy as stated in your listing. If the buyer files a claim for item not as described, you have evidence to show that the size was clearly communicated and should not be held responsible

Whammyyammy · 13/02/2023 23:36

Sadly ebay will probably side with the buyer and issue a refund.
Then it's a gamble if buyer returns the coar, or and ikd jumper, will still get proof of return and ebay will still side with them.

Stopped using ebay for this reason

Thelnebriati · 13/02/2023 23:41

8/10 if you tell them to return the item, they suddenly change their minds and decide there's nothing wrong with it after all.
