To expect a FULL refund?

The facts-

I booked a trip, it was a supported cycling trip from London to Paris. Originally leaving London on the Sat at lunch time, arriving in Paris on Sunday at lunchtime. My plan was then to fly home and make work on Monday. I can't take time off Mon-Thursday out with prearranged holidays. This was booked last year and was for this May.

Got an email the week before last to say they had tried to book the ferry only to find out there was no ferry on the Sat night. The trip was postponed to leave on the Sunday eve and arrive on the Monday eve. This means I can't go.

They have offered a refund but minus £50 for 'admin'. I'm not sure why this is annoying me so much but I feel it's really cheeky. Essentially I am being fined for their lack of organisation.

The T&Cs only reference an admin fee in cases where the buyer cancels.

Do I just need to get over this or is it worth an email?

Why should you claim on insurance when it is the organisers who have changed the arrangements?

I would send an email and I wouldn't strain myself to be diplomatic about it. Diplomacy will only signal you are a push over to these cheeky fuckers.

My email would go something like:

Thank you for your email regarding the change of departure. Unfortunately the new dates will make it impossible for me to undertake the trip. Given the change of arrangements have been initiated by you I anticipate a full refund and do not expect to cover admin expenses.

This

They are being cheeky fucks, but I would insist and point out that they are not honouring the contract they had with you and have made it impossible for you to attend an event you were looking forward to. Any by the way, congrats on being so hard core you can cycle to paris over the weekend and then go to work on Monday! I would need a week off to recover!

@Silverbook

I'd be quoting the relevant sections of the package travel res, namely part 3. You're entitled to a full refund within 14 days as They've changed the terms of the contract which you do not accept.

www.legislation.gov.uk/uksi/2018/634/contents/made

I'm assuming it's a package? They've booked outward travel and accommodation for you?

Yes. They book the ferry crossing and accommodation in Paris.

@Silverbook then it qualifies as a package - needs two or more elements bundled together - and the law is on your side.

Refund in full to your original form of payment within 14 calendar days.

CrazyLadie · 31/01/2023 10:46

Silverbook · 29/01/2023 16:41

You had me doubting myself!

So when do you get your May Day holiday then?

BlueLabel · 31/01/2023 12:46

CrazyLadie The OP posted what holidays she gets in May earlier in the thread.

Don't get sidetracked into trying to claim on the travel insurance. They insure you for things that happen to you, not the operational incompetence of a tour operator (that's why they might cover flight delays due to shitty weather or a mechanical issue and not 'operational reasons' - those are where the airline/operator have the legal responsibility), so it would completely waste your time.

They're liable for a refund of the full amount.

Edinburgh schools are off the 1st and 2nd of May. Each council area is different, you can’t just say ‘I’m in Scotland’.
Anyway, tell them they are in breach of contract, and you will settle for a full refund as compensation.

Good lord. Of course she can just say that. She’s a grown woman. She doesn’t need you to check if she’s working or not. If she says she is. She is. You take her word for it.

I can’t even believe you wrote that. Like it was your job to check her schedule.
