To ask HA to fix front garden

Moved in a year ago
the footpath slabs are broken and uneven
the front garden is uneven it causes massive water logs when it rains to the point you can’t get in and out the house
the HA say this is my responsibility
I say it’s theirs who is right ?

I would think your contract/ tenancy agreement contains the answer. Who does it say is obligated to maintain the front garden/ access?

Check your agreement.

My grandfather has to maintain his garden excluding any major groundwork issues generally.

I suspect the time to get them to do it was before you moved in, and they may have passed it to the next person anyway - do yo have pictures or proof it was like that when you took it over?

Its absolutely your responsibility I'm afraid. O believe the council have to fix broken slabs on public pathways if they are a than 1/2 inches uneven but I don't think it's the same for private as my sister ended up doing her entire garden herself. When she moved in it was that water logged and the broken flags were Flapping that much in the muddy puddles of her garden that she had to put her oldest rug on them to prevent splash back. It took her DP 7 full weekends to dig buried car parts, kitchen sinks etc out of the grass, level it and replace the patio paving and the terrible path way.

Depends on your tenancy in mine they are responsible for the doorstep and the shared path at the front and the door step and I think a foot surrounding at the back they are not responsible for the back pathway in the garden 🤔 but they are (I think) responsible for the step UP to the pathway in the back

I would say, if it’s like HA in my area they are right it’s your responsibility

I think its probably yours tbh ,I live in HA house they won't even maintain the fencing in gardens ,the only reason I got new fencing from them was after an OT referral that said the fencing was a health and safety issue for my disabled child

You're going to find you are wrong I'm afraid. The tenant will be responsible for maintaining the garden and keeping it in good order.

Mine would have replaced the broken slabs before I moved in, but the rest of the garden is my responsibility.

HA staffer here. You will very likely be responsible for maintaining your garden but if you can't access your property due to flooding then your HA will need to remedy that. Check your tenancy agreement. Your housing provider is responsible for keeping your home safe and in good repair, and if you genuinely can't get in or out they will have to take action. If you are looking to get your garden levelled or similar to improve the way it looks, that will be your responsibility.

When you speak to them make reference to the Regulator of Social Housing's regulatory standards. If you don't get anywhere by going through your HA's complaints process, you can take a complaint to the Housing Ombudsman. Good luck.

I think they should sort out the slabs and you need to level the garden
