DLA renewal - worried

SharonB2 · 12/01/2023 21:39

I last made a DLA claim for child in 2016, it’s due to Renew this year
nothings changed as this is a chronic condition only thing that’s really changed is that DC sometimes does some of the things themselves but this needs oversight abs sometimes it takes longer doing it this way

I’m really worried as I’m now reliant on buying stuff they need to manage the condition and I’ll struggle if we don’t get it

How old is your DC now?

SharonB2 · 12/01/2023 21:41

13

Oh and what rates do they get?

SharonB2 · 12/01/2023 21:42

Higher

I hope it goes well for you. It's a disgrace that you have to go through it again for chronic conditions.

springerspanielpuppy · 12/01/2023 21:47

High care what about mobility?

Its true that DWP reassess because your DC may well be able to manage more at age 13 than at age 6 or 7 and it is needs based. Do they have an EHCP do you have evidence of their need. Do they have help in school? If they have high care do they still need help often during the night? All of these are things that could change an award. However you need to explain that they still need supervision to do some tasks and what would happen if they didn’t have that support.

MargaretThursday · 12/01/2023 21:48

As far as I can tell it's random.

Dd is missing her arm. Despite filling out the form pretty similarly (it doesn't grow back surprisingly) over the years we had everything from middle level to nothing. Similar with other people with the same condition despite it being something with is reasonable consistent what they can do.

DreamCatcher08 · 12/01/2023 21:51

I know the worry and I really feel for you! My sons was up December just gone and they left the renewal the day before as they forgot to send it to a decision maker! My son will move to pip in a year and his condition is well known for not getting PIP after getting HRC for 14 years! The stress is unbearable

Theunamedcat · 12/01/2023 21:52

They are running massively behind at the moment so get it in but tracked delivery I've just been through it they renewed but only for two years (better than not at all) however some people had theirs refused on renewal despite being HRC prior so it seems to be a bit of a mess right now

The renewal papers are shorter than original which is better make sure you take copies in case they lose it and copy the evidence never send originals

hiredandsqueak · 12/01/2023 22:04

@DreamCatcher08 ds had had HRC and HRM on a lifetime award since he was 11. On the move to PIP he got no award, still no award at Mandatory Reconsideration, went to appeal. DWP had no reasoning for their decision, couldn't answer any of the panel's questions, the only question they had for me was to ask whether he had ever been to a football match Confused. He was awarded HR daily living and HR mobility backdated and for five years and at renewal I sent the Tribunal order with the form and he was given an indefinite award. Make sure you use the guides from Benefits and Work, send in reports from all the professionals involved (DWP hadn't looked at them instead relying on a report from a physio when ds had no physical needs) and appeal if you have to

SharonB2 · 12/01/2023 23:19

Thanks all
map worrying
the thing is that we only have a GP involved now as we got closed to the 2 x consultants as we have management for the condition so doctors will confirm the medication and that’s it no specialists involved anymore

OP posts:
SharonB2 · 12/01/2023 23:21

It did worsen on 2018 and we ended up abused another specialist for a something related but again we were closed to them last year in 2022

Abused? By a specialist? I’m confused?

springerspanielpuppy · 13/01/2023 02:45

You don't need a consultant or specialist if there is nothing more that can be done you explain that it is managed by the GP. However you will still need to write her needs in the form and what help she has throughout the day including what input she has at school.

Sometimes a child has a disability or condition that does mean that they have a high level of need at age 6 or 7 but by age 13 they manage the condition themselves or need less help or less supervision. I'm not saying that is your child as I don't know anything about them.

As app stated, use sites that can help where you feel able to talk about her condition and needs.

Mummyto2boys22 · 28/01/2023 21:51

Hi everyone hope you can help me- DLA renewal form has come through- my child’s care needs haven’t changed but has received 2 diagnosis since my last claim. on the question where it says has their needs changed do I tick yea and then put has 2 additional diagnosis but care needs haven’t changed? Or write his whole care needs out again It’s so confusing

"Or write his whole care needs out again It’s so confusing"

Do you mean do you have to fill out all the information again?

Yes you do. They don't look at the old information and only go by what you write on this form and evidence you send in this time.

Mummyto2boys22 · 29/01/2023 00:27

Yes it asks to fill out the whole form again

Mummyto2boys22 · 29/01/2023 00:30

Thank you - can I just write exactly what I wrote on the first form because literally nothing has changed apart from them receiving an official diagnosis

Underhisi · 29/01/2023 15:28

Yes If nothing has changed you can write the same thing. Many people keep copies of what they wrote for this re

Autismum4 · 22/04/2023 18:12

@everyone does the renewal forms look the same as a brand new claim just with an added question "has the needs changed yes/no"?
Do I tick yes because my child's needs have changed they are worse but already get high care so obviously no award higher but its important that they are aware of the needs changing because his bones are breaking as a result of his impulsive behaviour and god its so horrible as a parent, I'm in a&e a lot with him..
Or do I tick no change to needs just include the extra needs described, along with NHS fracture letters, occupational therapy and paediatrics?

So sorry you had to go through that. The PIP decision making process is awful. I work in welfare rights, and less than 50% of the applications we do result in an award initially, but we have 100% success rate at appeals. The system is broken, cynical and corrupt.

I'm astonished the DWP sent someone to the appeal, though - they've never sent anyone to any of mine!

LakieLady · 23/04/2023 09:28

The converse can also apply though where there are conditions that don't improve over time. The difference in the degree of help/supervision a child needs when compared with a child of the same age without any issues can be greater as a child gets older. A 13-year old would usually be able to (eg) travel to school on their own, so being unable to do that would result in a need for supervision that wasn't present when the child was 5.

I suppose that it was because we went without any representation, maybe they thought we would be an easy win who knows? Whoever they sent had no knowledge of ds's claim, I think he had picked it up as we walked into court because he had no answers for the panel's questions. For us it was easy, we told the truth, gave examples of everyday life as we had on the initial claim with reports from health professionals to support that. Ds was always entitled, he always met the criteria, the physio had no understanding of the challenges autism presents and nobody read the evidence instead relied on a flawed assessment report.

Applied for DLA renewal scan date was 6th March 2024. Received letter 2nd May saying more info needed, upon looking it seems they have lost 2 pages of my application. Had to refill them in & sent back with special delivery. Called after a week to see if they received it, confirmed received. Received another day last week saying 'we received ur dla claim dated 6th March & are looking into it, can take upto 15 weeks' My son's current DLA runs out on 19th June, 2 weeks left and also received letter from carers allowance saying this will stop. Anyone any advice? Will they make a decission before the current dla expires which is 2 weeks away?
