Daughter moved into uninhabitable fiat, help!

Got the keys 2 days before Xmas. We helped her move in just after.
It was raining hard that day and an entire wall of that flat was wet from water coming through chimney breast and or roof.
She also has water running down the walls in her bedroom, mould and damp bedding and clothes.
She has the heating on and extractor fans going while cooking and showering. Windows open. She's wiping moisture 3 times a day from windows.
She suffers from asthma and can't stay in it, but how does she end her tenancy?

Call the estate agent and if they refuse to do anything about it call environmental health. I did the same once and they condemned the place and I moved out the same day and got my deposit back the next day

onepieceoflollipop · 08/01/2023 22:22

What has she done so far e.g. consulted the agency or owner?
some or all of the problem could be a leak from the chimney or roof as you mention which the owner may not be aware of if it suddenly occurred?

MichelleScarn · 08/01/2023 22:23

Private let or HA/Council?

liveforsummer · 08/01/2023 22:23

Who did she rent through? Surely just go back and say what you have to us. Take photos. Tell them you are contacting CAB, your local MP, the council etc

Treacletoots · 08/01/2023 22:25

Has she contacted the landlord/ letting agent. They may not be aware of the issue and would prefer to resolve it!

Annoyingwurringnoise · 08/01/2023 22:29

You need to double check this, but I think you can wind up a tenancy within 60 days if the flat isn’t satisfactory. Google it, see what comes up.

FrippEnos · 08/01/2023 22:31

Even if the letting agency and landlord do something about this it will tale months to sort out the issues of the flat.
She would be better getting out of the tenancy and finding somewhere else.

And I know that it isn't that simple to find somewhere at the moment.

Shelter should be able to offer advice

Thank you for your replies. She's going to get on to estate agent and speak to her legal team at work

Surely she’s called the estate agent. What have they said? You don’t need advice from people on the internet to know that’s the first thing to do. What else would there be?

Smokeahontas · 08/01/2023 22:58

Should have gone for an Alfa Romeo

🥁

WinterFoxes · 08/01/2023 22:58

A friend's DC moved out within a week from a place with black mould and got their deposit back. She needs to speak to the agent immediately.

BabyOnBoard90 · 08/01/2023 22:59

Estate agent / landlord will probably be better positioned to help you than this forum tbh

Good luck

Annoyingwurringnoise · 08/01/2023 23:05

I would strongly advise her to do her own research. IME letting agents and landlords very rarely know the law and are even less likely to tell the truth/offer advice in the tenant’s best interest.

harrassedmumto3 · 08/01/2023 23:07

It seems unrealistic to say they wouldn't know about it. They should be, as these issues don't arise overnight!

Hope you get it sorted, OP.

She's only been there a week. It's Sunday night, she plans to take action tomorrow, but I wondered if anyone had any experience of this

RambamThankyouMam · 08/01/2023 23:16

She's lived in those conditions for a week??

KnickerlessParsons · 08/01/2023 23:20

Why did she move in?

😂

Startwithamimosa · 08/01/2023 23:36

Surely this is illegal?

dingit · 08/01/2023 23:38

KnickerlessParsons · 08/01/2023 23:20

Why did she move in?

Once you've signed a tenancy agreement you are liable for the rent. The mould has built up through the week. It hasn't stopped raining all week either

OP posts:
dicker · 08/01/2023 23:40

Why on earth didn’t she phone the agent straight away?!

Lysianthus · 08/01/2023 23:45

Sorry OP, can't believe you left her in that flat. We're talking 10days now? And as other people have said, why are you asking us? It's the landlord who has to respond. Poor girl.

dingit · 08/01/2023 23:51

She moved in 1/1, she stayed with us over Xmas. She informed the agent of the penetrating damp on Tuesday morning ( first working day). They have been on to landlord. The condensation and mould problems have appeared through the week.
We had no idea just how bad it would become.
