To think they are taking the piss? It's making me ill

I posted previously about a leak I had in my bathroom that I reported to my housing association.

It was severe and under their policy constitutes and emergency (should be seen to within 24 hours). I contacted them several times with no response, my entire landing carpet was saturated, including some of the stairs and into my bedroom.

It was soaked for three weeks before someone came out to fix the leak and wet vac the carpet. The carpet is still soaking wet.

I made a complaint over two weeks ago, and was told someone would be in contact within five days. Nobody contacted so I had to reach out yet again.

They have said the best they can do is offer £150 compensation?!

The carpet is ruined, stinks and is causing mould. I have a four year old DS and I am asthmatic. It has soaked through into the living room.

£150 won't pay to replace my carpets, that never would have needed to be replaced if they had coke out when they were supposed to in the first place!

Do I accept this or try and push more?

Claims have to be made within 24 hours and the excess is £350. I can't afford that right now.

I think pushing for them to rectify the problem is more important at this stage than compensation.

As the carpets are soaked from the flooding and cleaning, they should have a professional cleaner to extract the water - or if ruined, be ripped out and replaced.

That’s the conversation to be having with them.

It was their responsibility to fix it and they didn't.

I also pay a service charge every month.

Tell them they need to replace like for like - carpets etc. get quotes for the same quality etc

You should push for more.

You should not have to claim on your insurance but it may be that your insurer can help to pursue the Housing Association - have you contacted them and asked them?

They should replace what was damaged as a result of not following their own policy.

Yabu, why didn't you ask for it to be repaired sooner, or could you have put a bucket/sandbag to prevent further damage? Or called a plumber yourself?

They need to come out and pull up the carpets, if they are still wet then the floorboards will be soaking too. They need to it dehumidifiers in to dry everything out and then they need to replace the carpeting.

If you are having no success direct with the HA then try contacting your MP, or googling the CEO of the HA and emailing them direct. They won't actually reply but it just takes it to an escalated level of customer service.

You were given a lot of advice on your last thread about who to contact and what steps to take. Sounds like you haven’t followed up on any of the suggestions people took the time to make. Why don’t you go back and read your last thread and follow those suggestions?

I did. I asked on the day the leak started and contacted them multiple times over weeks. That's the whole point.

The leak was too severe to be contained.

I cannot afford a plumber. I pay a service charge exactly for this reason. It is the responsibility of the housing association.

For anyone who didn't read the previous thread and because the information isn't in this one, the OP has a physical disability that meant she wasn't able to switch off the water so the water was leaking for a number of days before anyone was sent out to switch it off and repair the leak.

It's annoying when a grown adult has 0 comprehension skills.

What I am asking, is completely different to the previous thread. If you can't already understand that, then there is no point me explaining it to you.

I think this is a case for the ombudsman too.

Was your original complaint made in the formal sense, ie using the HA's complaints procedure? If not, you may have to exhaust their own procedure before you can go to the ombudsman.

Do you know how they came up with the figure of £150?

Could it be that they are trying to settle on an indemnity basis, rather than the ‘new for old’ used by many insurance companies?

Even if they are using indemnity figures it seems reasonable for them also to cover the labour costs incurred taking up the damaged carpets and laying the replacement.
