Tonight I went a bit nuts buying used clothes and a coat on ebay for a relatives daughter for over winter. I messed up, didnt realise how much I was spending and it ended up being over £100 which is more than I feel comfortable with. But even then I have realised that I was unknowingly buying things in the wrong size. They are way too big and they need clothes now. They wont have packaged, printed or sent anything yet. I have explained and asked for a refund but not sure if they will or have to.

You'll have to wait and see what they say. Or press return now so it is a formal process.

Two different situations spring to mind:

  • in auctions the contract is complete the moment the hammer comes down on the bid.
  • in distance selling the buyer has a 2 week cooling off period and a right to return things.

I think that with second hand goods and / or small indepedented sellers who don't operate a business on eBay the later may not apply (I can't remember).

Cancel the orders immediately.

It would be up to the seller to cancel them, depend on if they want to, have packaged it or so. You can additionally send a message to the seller explaining that you got the wrong size and that's why cancelling it.

Maybe some would understand. I've done it before, one sent it anyway and I had to accept it but another one cancelled it.

Just FYI if you as a seller cancel the order because of a buyer request the seller does NOT get charged for fees. (They do if they cancel of their own volition).

Because you entered into a contract with them. They invested their time in doing the photos, listing etc. You pissed on that. Why put them out when it is your mistake?

I suppose the point is that the seller is not inconvenienced by your mistakes or lost sales.

It may not be serious, but the principal is the same, don't agree to pay for something, and then don't.

The seller is inconvenienced, they have to re-list the item and wait for someone else to pull the same stunt in 7 days time.

You can ask to cancel but they don’t need to do it and they might not.

What were you thinking? You're so out of order. Most people don't mess about selling for the shits and giggles. Money is tight and it's nearly Christmas, you've led people to believe they've made a sale and are now wanting duck out of your contract just because you felt like being silly. These are people, not a massive company.

You can 'realise' the sizes by reading the item description Hmm

And it's not just about sending it out. The seller will still get charged eBay's listing and final selling amount fees even if they cancel OP's order.

Why should the seller be out of pocket? The fees can be as much as 12.8% of the total amount. So £13+!

My point was in response to OP saying that she could not see the point of going through with the sale and relisting the items herself.

I was definitely NOT saying that the seller would not be inconvenienced if OP did not go through with the sale.
