Who is in the wrong here? Re two car drivers.

Please tell me who is in the wrong here.. I understand it’s probably both but what would happen if it went to insurance?

I was passenger in car A.

car A- fails to stop behind a parked vehicle and give way to oncoming vehicle but would of made it round in enough time if the oncoming car went appropriate speed.

car B- on coming. Notices car A has not given way and puts his foot down and aggressively speeds up towards car A.

the result of this was both cars clipping wing mirrors but could have been worse.

car A pulls over as wing mirror was pushed in and 30 seconds later Car B has turned round and parked behind car A.

Car B driver gets out his car and aggressively starts shouting that Car A driver has knocked his wing mirror off. car A driver apologies and mentions that car B driver was coming fast and that he should of slowed down. Car B driver agrees to putting his foot down but said that it’s his right of way, he wasn’t stopping.

who is in the wrong?

Car B, aggressive and not judging oncoming traffic correctly (either)

If the hazard is on your side of the road, you have to stop. So car A.

I thought if an oncoming vehicle is already overtaking the parked cars whilst you are approaching, then you must give way even if it's your right of way. I think car b, they purposely put their foot down to go faster knowing it wasn't safe to do so.

The obstruction was on car a's side and they could see car b approaching so car a is definitely in the wrong. Whoever the driver is, they need a driver refresher course or to get off the road. They're a danger to themselves and others

Insurance purposes car A as rules of road are they should have given way to car travelling on correct side of road.

Car A was wrong in terms of the Highway Code because B had right of way.

Insurance wise A would be held liable.

If car A had enough time to get round, but car B sped up, then that muddies the waters.

Car A didn't need to stop because there was space and time to go round.

A made a mistake - although you mention they would have had time if B hadn't sold up, so maybe they didn't make a mistake?

B was a twat.

And to confirm car A was on the wrong in line with the Highway Code. Car B may have been an arse but not wrong according to the highway code

Car A is more in the wrong as the driver blatantly ignored the fact they didn't have right of way.

If a vehicle is approaching, you CANNOT and SHOULDN'T attempt to overtake an obstruction on your side of the road. Possibly being able to clear the obstruction in time as long as Car B travels at an appropriate speed is a completely unreasonable "excuse"!

Driver of Car A needs to read the Highway Code again....
