Delivered the wrong item - can I keep it?

I ordered some shoes and I’ve been delivered completely the wrong ones. The thing is, the ones I’ve been delivered are twice the price of what I ordered and they fit my husband perfectly!

Not really an AIBU, but does anyone know if I can just keep them? Would the company contact me?
The address on the parcel is correct but inside the package was a packing slip with a different name on it. So I think it could be traced if they return their shoes, which they would surely.

Just call them and explain. If they want them back they will arrange for them to be collected. If not, you get to keep them. It helps me to think what would I want someone to do in this situation if I owned the company

If it's a big chain, they won't notice unless you tell them....

Which then argubly makes it even more dishonest to not contact them, of course.

I would let the retailer know, but they would need to arrange collection
I think they would tell you to keep them anyway.

Basic definition of theft.

(1)A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it; and “thief” and “steal” shall be construed accordingly.

"Appropriates”.

(1)Any assumption by a person of the rights of an owner amounts to an appropriation, and this includes, where he has come by the property (innocently or not) without stealing it, any later assumption of a right to it by keeping or dealing with it as owner.

That act is for property that has been found in the street for eg, or stolen goods that have been handed on. It has to still belong to the owner. It doesn’t cover wrong orders sent out from shops. I don’t need to read the theft act thanks, I know it. I wish people like you would just go away 🤦🏼‍♀️

I would definitely contact the seller. Wouldn’t you feel a bit ashamed of yourself when you see your husband wearing a pair of more expensive shoes you didn’t actually buy?

I would email or phone the company and say they’ve sent the wrong style of shoes but your happy to accept them to save the hassle of returning them. Explain that they are more expensive but if they’re happy to let you keep them at the lower price it will save them the cost of collecting them.

Depends on your morals. I ordered some stuff from Ted bakers and they mistakenly included male shoes in the package. They were £70. The receipt in the bag was correct and only detailed the items I had ordered. I checked my bank and I hadn't been charged for the shoes. I contacted Ted Baker, they thanked me for my honesty and sent a prepaid label. I posted them back to them and got 20% off my next purchase for the trouble.

How is it stealing when these were sent to OPs house? She didn't ask for these to be sent. They willingly gave them to her.
If you go to the supermarket and buy 6 bottles of wine, and when you go home you check your receipt and the cashier missed one and you got charged for 5 - do you drive back to the supermarket, queue at customer services and return it? I don't think so

I wouldn’t go out of my way, but I would offer to pay the next time I went in (and have done so in similar situations in the past).
Your true character is what you do when nobody’s watching and you are guaranteed not to get caught.

Lots of things aren't technically "stealing" but are morally dubious at best.
What if you pay by cash in a shop, then the cashier gives you your change AND your original note? You've not gone into the till and stolen the money but you have had goods you've not paid for and your original payment back plus change. This has happened to me a few times, I've always let the cashier know and sorted it out.
You can justify the OP scenario if you are so inclined, by saying she didn't physically walk out of a shop with stolen goods, but in today's online retail world, it is the equivalent scenario. Once you are made aware of the issue, if you then choose to keep the wrong item/extra items then you are complicit in something deceitful.
If you let the company know and they decide to let you keep the items then of course that is totally different.

These threads always seem full of incredulous people who question those who say they would be honest about something like this. It's rather depressing that there are so many people who would not be honest.
The point is that the OP is aware of the mistake. It is what she does now that is the question.

Given the difference in price, they're unlikely to tell you to keep them.

But if you'd rather keep them, they might be willing to give you a small discount on the difference in price between the shoes you actually paid for and the shoes you received, given it will mean they don't have the hassle of processing a return, and they made the original mistake.

I would contact and have always contacted the company. Regardless of size. I always find the comments of 'if it's Amazon, fine' to be a bit ridiculous. You're either against theft or for theft.

I ordered something from a company and payed for delivery within 2-3 days. They refunded me after a month but the item turned up a few days after the refund anyway. I contacted them to let them know it had arrived, by which point the item was on sale for a lot less, but they still charged me the original invoice and gave me the £2.99 delivery off "to be nice". I couldnt get to the post office to send it back which they knew as I lived in the middle of nowhere. I thought theyd do a nice thing and just give me the discount. Im beginning to think they did that on purpose now.

I ordered something and the retailer put two of the items in my parcel when I'd only ordered one. I sell online and am plagued with scammy customers which piss me off no-end, so being the honest little soul I am (Grin) I let the retailer know (much to the disgust of my immoral DH)

They sent me a postage label to return it - but it was half-term, and there was postal strikes so I took about a week to get round to it. In the meantime the retailer was sending me semi threatening messages ('if you've decided you want to keep it we'll just charge your card' - yeah ok dickhead, I'm a retailer myself, I know you can't do that Hmm) and was a massive pain in the arse all week.

Didn't even get a thank you for returning it (200 quids worth!) - or had any decent karma for my exemplary conduct, so nah - fuck it, keep them!

Ironic - I'm a small business owner operating on Amazon. If I was the Amazon seller in this instance I would likely tell OP to keep the item but I would really appreciate the honesty and the chance to actually provide the correct item.

Unfortunately a lot of my customers seem to have a similar attitude towards products bought on Amazon that they're sticking it to the man or something, but actually a lot of small businesses use Amazon as an e-commerce platform.

If you have the packing slip with someone else's details...I'd be concerned about who had mine.
They need to know there's been a data breach, so I'd contact them.
