Very cross about this....

Just got back from the school run to find a Bailiffs letter through the door, used to this as it is a rented house and the last tenant was a scummy woman who NEVER paid anything... Any way this one has DPs name on it so I open it and it is saying that a bailiff has been and this is a "notice before removal" for outstanding council tax almost £800. Seems this has been ordered by a magistrates court!!!! This is the first thing we have had about this and.............. EXCUSE ME but the council tax is a Direct Debit and has been paid EVERY MONTH.

Can't decide who to yell at first the twat at the council office who probably can't even bloody read or the nasty little man whos name is on the letter.
Why anyone would want a job as a bailiff is beyond me, scum of the earth.

Called DP and he said (as I already knew) its a mistake.

God I wish the fecking bailiff would drop dead, causing stress to decent people.

Call them as soona s they are open and query it, letters are often sent automated from an admin personnel that has just had it come up on their screen, or from a baliff that ahs had it automatically forwarded to them by mistake.

Often these things can be checked quite simply and rectified.

This letter was hand delivered VS, and their was a bloke sat outside in a van when I came in, I think he may have been the bailiff, cause he watch me and DC come in then drove off.

I'd be very surprised you got a visit from a baliff rather than just the usual letter if there was nothing in it.
Can you get onto your account online?
If you're sure that money has been going out of the account then you need to check it has been paying the right bill.

We had this and it was to do with our council tax. \

It turned out to be the way DH bank sent the money to the council, so they were receiving the money after the cut off point. We just had to change the date on the direct debit.

As far as I can see, payments have been made and on time.

Strikethemdead, first you need to check whether you have a county court "judgement in default" against you. If you do you will need to apply to have it set aside asap. If you don't it will badly affect your credit scoring.

If this is the first you have heard of this then you where probably never notified of the claim which should make things easier. Then talk to your council and the bailif.

A solicitor or your local CAB should be able to help you. Once this is sorted out, I would ask for an apologie and compensation.

I will see what DP says when he gets in as he was going to phone them.

I am sure it is a mistake because I can see the payments have gone out.

I am still worried though.

There was an article in the Times today about just this situation - it may not be easy to sort out with a phone call.

But bailiffs can't just barge in - they may pretend they can, but they can't. Refuse point blank to let them in.

In our old flat, someone was using the address to open bank accounts, get credit and store cards and running up thousands of pounds of debt. We had bailiffs coming to the door, threatening letters etc. (Even someone peering through our letterbox)Eventually we opened some of the post addressed to this other guy and rang some of the companies to warn them what he was doing. We got told off for opening his post. Didn't bother trying to help after that.

But surroundedbysnot is right, if you explain to bailiffs that the person they're after doesn't live there they'll go away.

It would seem it is not the council of the area we live in now but DP old flat
DP called the old council today and it seems despite telling them he was moving and paying up to date and registering at this house and paying council tax here for the past 2 yes folks 2 years that the old council were still billing him at the old flat!!!
Morons every bloody council worker I have ever had to deal with is a feckwit moron.
Anyway we just have to send them the lease for here to show them that we have lived here and PAID here for 2 years.

I know it may not seem much upset to some but this sort of thing really really upsets me, and i have been worried all day, I would not stay in my own house in case they came back.

Hopefully we send them the lease and the crawl back under their stones.
