To ask how I get DS passport back

Posting for traffic.

Going through court. My DS's passport resides with his currently estranged father. Not finalised for a few more weeks but the recommendations are that DS lives with me and has supervised access with father.

I have asked for the passport back. He has said he has 'lost it'. I have asked if he had reported it as lost he said 'nope.' He has PR.

Do you know what can be done in court? Can I report it as lost? Do i need to get this added to my court application? Passport is needed by April.

When I report as lost it said do you know where the passport is, if you say yes it says to contact court, I don't believe for a second it is lost hopefully they will cancel it. I'm so stressed about it.

Apply for a replacement as the passport is lost. The old one will be cancelled so rest assured he wouldn't be able to use it.

Just report it as lost and apply for a new one. Surely you know there is absolutely no chance of this man being reasonable or considerate.

But you have no reason to answer “Yes”. The truth is YOU don’t know where it is. He says it’s lost, so take him at his word and answer “No” so you can have the replacement issued to your address

Definitely just say it's lost. Apply for a new one and take back control.

Unless the dad loses PR as part of the court process he will have to sign the application for a new passport. I would try and sort it through the court tbh as you are already there. Don’t give him another chance to play silly buggers!

That's not true about him having to sign it. My ex has PR and when applying for a new passport I wrote a letter explaining circumstances and no issues.

Thank you I've reported as lost they've said they will call me within 24 hours I can only go on his word. Just don't want to get into trouble 😕

You are not going to get in trouble.

You just say that his dad had the passport and has said it's lost. You're not lying.

My dc's dad has PR but I've always applied for passports without his knowledge or consent and got them without any probkems. As others have said, just state it's lost and go from there.

You won’t get into trouble, he told you it’s lost, so you are doing the right thing by ordering a replacement as you need it for April.

I applied for my daughters new passports without their fathers signature. Only one parent has to sign, but you do have to give the other parents details if known.

When they call explain he has stated it is lost also ask the question do you NEED to provide his details

if you get a residence order in your favour, it will include a clause at the end saying that neither of you can take the kid out of the country for more than 30 days without permission from court or the other parent, you can also push for a clause saying who keeps the passport and in which ways it handed over between the parents.

As previous posters have said, tell them its lost - because it is and regain that control.

Why on earth does the application ask you if you know where it is if you are claiming it is lost?

If you knew where it was it wouldn't be fucking lost would it?🙄

This was one of the reason I applied for court in the first place for a bit of control back due to refusing permission and other controlling behaviours, it then escalated quite rapidly and they have decided that it's in my sons best interest for supervised access until he does a series of courses. Which I can't see happening. He's advised CS and cafcass he will see him when he turns 16. Its all very sad.

There is a difference between knowing it has been stolen, having no idea where it is, and knowing it drowned in a lake.

Do the court proceedings include an application allowing you to take your child out of the country in April? If not, it might be sensible.

You may be contacted as the ppt office may want further info about the "lost" status before issuing a new one and cancelling the old one.
It is worth keeping your solicitor up to date with this- the fact your ex has the ppt but says it is lost etc especially if he is difficult when you travel with the child.
