To be notified if I am not going to be paid the wages I expect?

Can anyone help with some self employment/sole contractor rights with money...


Self employed working for one firm permanently, submit a time sheet every week with hours completed, they have not paid me for that amount of hours with no contact as to why. When I have queried why they have come back and said it's because a piece of paperwork hasn't been submitted as that job wasn't complete yet, so they didn't pay me the hours paperwork I get a day. This has never been an issue and they have never notified me that that would happen.


It's an easy fix as I can prove the paperwork is there and the hours will go on next weeks, but they didn't tell me, surely there is something stating they have to notify me they are not going to pay me what on my time sheet??anyone able to help?

What’s in your contract about payment? If you’re (properly) self-employed then you can say what your payments terms are, they agree (or you come to mutual agreement) and if they don’t stick to the agreed terms they would be in breech of contract and liable to whatever sanction the contract states.

Ultimately, you can stop offering services to them unless they pay you.

BUT…I’m guessing you need then money and are probably on a low(-ish) paid job? Are you actually self-employed? Have you checked the HMRC guidance? If you’re not, then your “employer” has to adhere to standard employment law ie contract, payslips, no unlawful deductions, pay slip, holiday pay etc. Which one of you has the power in the relationship? Who dictates what happens?

The practicalities of getting your money and what should legally happen are probably vastly different. Are you likely to not show up until they pay you? Probably not. Are they going to pay you when they feel like it? Probably.

I am self employed, technically a sole trader. I am employed by them and I don’t work with any other companies, very well paid job, not a low paid job at all. we don’t have a contract as such. I give them my weekly hours and they pay me my hourly via an outside ‘agency’
