Neighbours trampoline

My Mums neighbour leaned her trampoline on her fence and it has now on the fence for a year.
it leans over onto my mums side of the garden and is ruining her plants. The neighbour has been asked politely to move it four times, she has refused to move it. She says it’s her fence and can lean whatever she wants on it. The housing have been no help at all, they haven’t responded to phone calls or emails. Can I dismantle the part of the trampoline that is over my mums side of the garden or am I being unreasonable?

She needs to 'sad face' story the local paper. Give it some publicity. They will love this...

Usually the 'best' side of the fence is given to the neighbour. I live on a large newish development and all the fences have the posts and horizontal supports on the owner's side. My old house was the same.

Is definitely check out ownership first.

Then I'd have a bbq right underneath it.

Give her notice that you plan to trim her overhanging trampoline back with an angle grinder in the next seven days if she doesn’t move it.

love this suggestion. And the fat balls. Especially the fatballs. And fast growing creeper plants.

In reality? Probably i'd tell her to move it within 7 days then I'd use a clothes prop to stand it up so it doesn't encroach over my mum's garden.

a bbq or better yet a chiminea fire pit under the bit that overhangs your side. Very sweetly let her know she might end up with a melted/burnt trampoline and if she doesn’t move it. If it still stays there, light ‘er up.

I have seen several people suggest barbecue or fire pit to burn the trampoline. Isn’t that rather dangerous right next to a wooden fence?

I think the fence definitely belongs to her.
I’m thinking this because on your mum’s side she has the horizontal supports. This means the neighbour has the “smooth” side which indicates the fence is hers and is thus her responsibility to look after, lean what she likes against it.

Typically, you can guess who owns a fence by seeing where the rails are, with the fence typically facing away from their property so that their neighbour gets the ‘good’ side of the fence. This is the most secure way of facing fencing so there are no rails for anyone to use to climb into your garden. This is then repeated with the neighbour on the other side to ensure that each home has both a ‘good’ and ‘bad’ fence side. This isn't always the case however so always good to check legal documents.

you can buy a copy of your mums deeds and a plan for £6 from www.gov.uk/search-property-information-land-registry

in terms of how to force her to act your only option would be the legal route as it may seem petty to some but obviously not to you. This can be done online and is very easy and if your mum has home insurance she may have legal cover or a free legal line for advice etc.
