AIBU to tell our buyer to fuck off?

We put our house on the market in March. On the first day of viewings we had multiple offers. We went with a particular couple (even though their offer wasn’t the highest) because the agent stressed that they were very proceedable and had a high deposit so wouldn’t have any hiccoughs with their mortgage - and also because they weren’t a landlord.

In July, they still hadn’t booked their survey or had their mortgage approved. It’s a character property and you’d be bloody stupid not to have a survey (even though we know the property is fine). This was very concerning because, when we had the survey on the house we’re buying, there was a six week lead time. After a few weeks of the agent chasing them and them dicking about, they said that they didn’t want a survey and their mortgage was approved. We thought they were stupid as hell not to have a survey but it’s their choice.

They’ve been pushing for a very quick move and this has mostly been held up by searches and the solicitors. We were due to exchange tomorrow and complete on Friday. As such, we spent the bank holiday moving all our possessions into a storage unit (we have a toddler and a newborn and are now living off a few items we can fit into just our car). We’ve got DS booked into a new nursery from Monday and DH has a new job near the new house (this is two hours from our current house). Obviously our risk but it’s not physically possible for us to have moved out on time with a short turnaround between exchange and completion - especially with DH and I both working full time.

Our agent phoned this morning to say that they’ve changed their mind and want a survey. We’ve told the agent that they had their chance and there’s no way. Even if it’s quicker to let them have their survey than find a new buyer, I no longer trust them not to fuck us around at every stage. We’re not reducing the price so the survey won’t help them anyway.

AIBU to say no to the survey (and curse them to hell for good measure)?

We’re moving (today!!)) and didn’t have a survey done on the property we are buying. Wasn’t a condition of getting the mortgage so they don’t necessarily need one for mortgage purposes. I’m inclined to say this was likely planned on their behalf so unless they commit to exchange tomorrow they will probably keep messing you around.

As others have said they exchange tomorrow as planned or you won't sell to them. Don't be bullied. They are either hoping you are desperate and will drop price or something has happened, they are messing you round and you are better off without them.

Don't be surprised if they say they want to drop the price as a result, but stick to your guns.

Our buyers said they were going to pay 25K less a day before exchange because the property was end of terrace and not a semi. We held firm (after advice from MN) and they exchanged at agreed price.

This is why you always take the highest offer never believe any old flannel about they are the most proceedable etc. They never are, just focus on the money.

Kind of. We can, just about, afford to buy the new property and also keep our current property if we transfer to a buy-to-let mortgage and release some equity on our current place and let it out. However, we’re opposed to being landlords and don’t want to hoard property, which is why we refused to sell the property to a landlord. But this option would still require getting reassessed and things so would take a few weeks to rework.

My guess would be to either delay (maybe they’re locked into a rental term and can’t afford to pay rent and mortgage for the next however many months?) or to try and strongarm us into reducing the price.

A building survey is different to a mortgage survey … op has already said their mortgage company undertook their own desktop.

That's dreadful of them. I agree with everyone telling them they either exchange tomorrow or it's going back on the market, I would also make it very clear that there will be no money off if they get a survey as the value has actually risen.

I have no advice but I can only imagine how annoying this would be if anyone has experienced this! My parents were buying a house off a nightmare seller and it caused so much stress. I hope they do go ahead with it today. Why anyone would leave something this late is unacceptable

We didn’t have a survey on our 90 year old house when we bought. It wasn’t an issue. We could see it was a wreck, we didn’t need a report to tell us that Grin

they'll be wanting a home buyers survey, which is different to the banks desktop.

Id tell them they're welcome to get a survey. AFTER they exchange tomorrow & complete on Friday! If they don't E & C as planned they can go find another house.

then I'd be working out my next best plan!

id probably look at delaying your purchase (given the situation that shouldn't be a problem) & staying in an air BnB/renting, possibly even renting the house you're going to buy as it's vacant. Depending on whether the 'executor' can be arsed with the hassle or not.

personally i don't think I'd want the hassle of renting your current home out, it's such a ball ache now.

If you can afford to, I'd tell them the time for a survey was 3 months+ ago. They have missed their shot so they either complete or pull out.
