Am I Entitled to Compensation?

BonnBon · 12/08/2022 07:57

Sorry for posting in AIBU but I'm hoping for some quick responses.

DH, DD and I are travelling from Manchester to Bahrain, changing in Dubaii Airport.

Although our plane was not officially delayed (boarded on time), we didn't take off until 35 mins after the departure time. When we arrived in Dubai, we were stuck on the the plane waiting to taxi for a good 25 minutes. So we missed our connecting flight by 10 minutes.

The airline has booked us onto a later flight but we are now waiting around for hours and will be getting to Bahrain approximately 6 hours later.

Any advice would be much appreciated! Sorry for any typos, we have been awake for 27 hours at this point 😴😴

Can't help with the flight issue, but Bahrain was home for a few years. I hope you have a lovely time there!

Get your compo face on and contact your local paper. Honestly, people what compo for everything. This is the nature of global air travel.

LIZS · 12/08/2022 08:01

I doubt it as the delayed flight is not within EU/UK. Maybe ask for a refreshment voucher?!

Soontobe60 · 12/08/2022 08:02

Who are you flying with and what’s the reason for the delay?

Minfilia · 12/08/2022 08:03

What a pain! I don’t know if compensation rules apply in this scenario though as your actual plane wasn’t delayed by the actual requisite amount of time (is it still 4 hours?)

Were both of your flights booked with the same airline?

Did you leave the minimum recommended connection time between the two?

If so your airline might offer something if you contact them but I don’t believe they’re obliged to.

Hopefully someone more knowledgable will help.

We were flying from Manchester with Emirates and that was late taking off, no explanation given. I thought there was some rule where if you arrive a few hours late, you're entitled to x amount. But I have no proof that the plane was late as it was never announced as delayed if that makes sense?

Doesn’t sound very long to make a connection - did the airline book your tickets?

BonnBon · 12/08/2022 08:06

Not long at all. Yes it was all done in one through Emirates website.

Not sure it qualifies for compo, but you could go back to the airline desk to see if they’ll give you food/drink vouchers

i was delayed coming back from Abu Dhabi and missed a connecting flight in Paris. I got compensation because the delay was more than three hours. All flight take off and departures are logged by radar and computer systems - so there will be a record of when the flight took off and landed. Have a look at flight radar. So proving the delay won’t be a problem. However I claimed compensation under EU rules so unsure what the entitlement is now.

functionoverform · 12/08/2022 08:24

Yes, it should be eligible for EU 261.

If your flight was one through ticket and departed from the UK, and the reason for the delay wasn't due to extra ordinary circs, then a delay reaching your end destination qualifies.

Make a note somewhere of flight numbers/ timings etc. You will need this for when you claim.

It's the time that you arrive at your final destination that counts here, so over 3 hours late, you should qualify. You are also entitled for duty of care. If they give you nothing, keep all receipts for food and non alc drinks to claim back as well.

Our flight was delayed for 5 hours on our return from holiday. We were given meal vouchers which was about £15 each. We missed our connection but managed to change to different flight when we arrived. We missed the option of refund by 20 mins! But this was based on the delay of 5 hours that they stated when we checked in. If we were delayed 5.5hrs we would have been able to get a refund! 3 hrs plus was meal vouchers which they gave automatically. Check on the airline website terms and conditions to see if you have a claim.

halfgirlhalfturnip · 12/08/2022 08:30

If booked on one ticket and you are late arriving you are entitled to EU261 unless for reasons out with airline control . There will be a link on emirates website and any good airline will pay this promptly.for a through journey that is over 3500 km you are entitled to EUR600 each.

Puglover287 · 12/08/2022 08:57

Not 100% sure if you will be but you can always try. Keep all your tickets and flight details. I’d wait until you get home from holiday. You can usually apply for compensation directly through the airline online. It might take a while for a response and for them to pay out but it’s worth a try.

araiwa · 12/08/2022 09:01

Does eu261 apply to flights from one non EU country to another non EU country on a non EU airline?

araiwa · 12/08/2022 09:01

Does eu261 apply to flights from one non EU country to another non EU country on a non EU airline?

Yes - in 2020 UK Gov replaced the original EU law with UK legislation. So even though the UK is now non EU, 261 still applies.

OP - unless there was a medical emergency or weather related issue with the late departure (sounds unlikely) you are entitled to compensation per passenger.

From Emirates website

Thank you everyone.

We are finally home in Bahrain after a further delayed flight and I have now sent a letter via their complaint section of their website.

Fingers crossed 🤞 I get a response soon.
