To be worried about DLA

My sons DLA runs out in November and I sent of renewal form and documents today. He has ASD and severe learning difficulties. He currently gets low rate Mobility and middle care. I empahasized on the form that he has refusal episodes to walk, they are because of his ASD and not a choice of his or naughty behaviour and he is prone to running away. I am a little worried that what it says on the paediatric report will stop his mobility. It says he is independently mobile but has absolutely no awareness of danger and must be constantly supervised, and needs guided because of sensory problems. It also confirms his sleep and toileting issues and that we have to attend to him at night. I’ve never disputed on the form that he CAN walk physically, there’s no physical reason stopping him being able to but his ASD makes it very very stressful and difficult to get around some times. I am really panicking that this will stop us getting his DLA now. We couldn’t survive without it as I have had to give up work to care for him and I go through clothes bedding and electric like you wouldn’t believe!

I wrote some times but I basically mean every time we go out.

You should get low rate mobility based on what you have said and also likely high rate care

BiscoffSundae · 01/08/2022 14:49

I get LRM for both my asd kids that can walk but limited awareness 🤷‍♀️ Not sure why you think it would stop? That’s what LR is for?

Christmastreejoy · 01/08/2022 14:49

Oh you also should be eligible for a blue badge!

Sprogonthetyne · 01/08/2022 15:02

I get lower rate mobility for DS based on his low risk awareness and need for close supervision.

LilacPoppy · 01/08/2022 15:04

Low rate mobility is not for physical reasons , the report literally confirms he meets the criteria so I am very confused what your concern is?

x2boys · 01/08/2022 15:06

I really wouldn't worry to stop an award they would have a reqson and mothing.you havecwritten suggests your child isn't entitled to DLA ,my son has similar disabilities and he gets HRC and HRM under SMI rules, maybe you should consider trying to get higher rates for your son?
I had to take it to tribunal but we got it eventually.

earlydoors42 · 01/08/2022 15:07

Sounds like low rate mob is absolutely made out, and possibly high rate care too if the night needs are every night and are prolonged or repeated

Mrsjayy · 01/08/2022 15:11

If he is refused then appeal and if you lose an appeal take it to tribunal, I mean he may get it renewed fine but if he doesn't don't give up. CAB can help you with appeals.

LilacPoppy I was just worried the decision maker would take the words “independently mobile” to mean he is independent and doesn’t need help which is definitely not true, I know it just means he is physically able to walk without aids but I was just worried the assessor would see that terminology and think he is independent. But I have literally said on the form he runs away and climbs on things he shouldn’t so obviously they will already know he must be mobile to do these things

No the assessors understand the terminology their guidance is very specific. You have nothing to worry about at all.

Techno56 · 01/08/2022 18:03

Try not to worry. What the doctor has said in their following comments is more than enough evidence for low rate mobility. My son's recently got renewed and he has lower needs than your son and I had no independent evidence from a Dr for this area of his needs.

Just be aware they have a backlog and probably won't look at it until a couple of weeks before it expires, this is what happened to us.

x2boys · 01/08/2022 21:55

Op you really should look into Wether your child would qualify for HRC and HRM under smi mu son was awarded mrc at three for 13 years and then he got lrm added on at five I knew his needs were significant he was at a special school onn 1:1 I did a change of circumstances when he was nine and ended up.gping to tribunal for high rate care and high rate mobility he was awarded it for three years I have just done a renewal and he's been awarded the same rates until we apply for Pip

This explains the criteria for HRM for children with autism
